It also enumerates the circumstances <strong>in</strong>which the courts will grant the relief <strong>of</strong> rectification<strong>and</strong> cancellation <strong>of</strong> <strong>in</strong>struments. <strong>The</strong> Act is <strong>in</strong> a sensea blend <strong>of</strong> common law <strong>and</strong> equity <strong>in</strong>asmuch as italso makes provision <strong>in</strong> a qualified manner for thewrit <strong>of</strong> m<strong>and</strong>amus <strong>in</strong> certa<strong>in</strong> cases. This statutepowerfully illustrates how those who were charged withthe task <strong>of</strong> draw<strong>in</strong>g suitable codes for <strong>India</strong> discardedthe dist<strong>in</strong>ction between law <strong>and</strong> equity <strong>in</strong> Englishjurisprudence, not hesitat<strong>in</strong>g to <strong>in</strong>clude <strong>in</strong> an Actdeal<strong>in</strong>g ma<strong>in</strong>ly with the equitable relief <strong>of</strong> specificenforcement, a remedy <strong>in</strong> the nature <strong>of</strong> the Crownwrit <strong>of</strong> m<strong>and</strong>amus.VI.INDIAN COMMON LAW<strong>Common</strong> law consists, as we have seen, <strong>of</strong> customaryrules <strong>of</strong> the realm recognised by the courts. In thatsense every country can be said to have its commonlaw, rules <strong>of</strong> conduct which apply to citizens generally<strong>and</strong> the rights <strong>and</strong> privileges which they can enjoy.Some <strong>of</strong> these customary rules prevail<strong>in</strong>g <strong>in</strong> <strong>India</strong>have come to be known as the <strong>India</strong>n common law.<strong>The</strong> right to a public highway is recognised <strong>in</strong> <strong>India</strong>as <strong>in</strong> Engl<strong>and</strong> as the common law right <strong>of</strong> the citizen.Anyone <strong>in</strong> <strong>India</strong> can set up a ferry on his ownproperty <strong>and</strong> take toll from strangers for carry<strong>in</strong>gthem across. 82 Similarly the <strong>India</strong>n courts have82 Maharaja Sir Luchmeswar v.
