162 <strong>The</strong> <strong>Common</strong> <strong>Law</strong> <strong>in</strong> <strong>India</strong>Crim<strong>in</strong>al Procedure: A glimpse at the manner <strong>in</strong>which those who have committed crimes are broughtbefore the courts <strong>in</strong> <strong>India</strong> <strong>and</strong> tried by them willcomplete the picture <strong>of</strong> the broad similarity <strong>of</strong> thework<strong>in</strong>g <strong>of</strong> the system <strong>of</strong> crim<strong>in</strong>al law <strong>in</strong> Engl<strong>and</strong><strong>and</strong> <strong>India</strong>.<strong>The</strong> repression <strong>of</strong> crime be<strong>in</strong>g a matter <strong>of</strong> seriousimportance to the community, the <strong>India</strong>n law providesthat <strong>of</strong>fences may be brought to the notice <strong>of</strong>the authorities either through the agency <strong>of</strong> the police,whose duty is to enforce law <strong>and</strong> order, or by privatepersons. Cases may be started before the crim<strong>in</strong>alcourts either on reports made by the police or oncompla<strong>in</strong>ts lodged by private persons. <strong>The</strong> ProcedureCode not only gives the right to make compla<strong>in</strong>ts toprivate persons but it makes it <strong>in</strong>cumbent on thepublic to give <strong>in</strong>formation to the police <strong>of</strong> thecommission or the <strong>in</strong>tended commission <strong>of</strong> certa<strong>in</strong><strong>of</strong>fences. 21 <strong>The</strong> duty <strong>of</strong> aid<strong>in</strong>g magistrates <strong>and</strong> police<strong>of</strong>ficers <strong>in</strong> mak<strong>in</strong>g arrests <strong>and</strong> <strong>in</strong> prevent<strong>in</strong>g certa<strong>in</strong><strong>of</strong>fences is also laid on the public. 22 <strong>The</strong> Code alsoentitles private persons to arrest persons <strong>in</strong> certa<strong>in</strong>cases <strong>and</strong> make over persons so arrested without unnecessarydelay to a police <strong>of</strong>ficer. 23 <strong>The</strong> law enjo<strong>in</strong>sall persons to attend before magistrates <strong>and</strong> police<strong>of</strong>ficers to give evidence about the commission <strong>of</strong><strong>of</strong>fences with<strong>in</strong> their cognizance whenever called uponto do so. 2421 Crim<strong>in</strong>al Procedure Code, 1898, s. 44.« Ibid., s. 42.23 Ibid., s. 59; cf.
