It may be said <strong>of</strong> these proposedmodifications <strong>of</strong> English law that while all, or nearlyall, <strong>of</strong> them have commended themselves to theapproval <strong>of</strong> enlightened lawyers, not a few are be<strong>in</strong>ggradually carried out <strong>in</strong> Engl<strong>and</strong> without the aid <strong>of</strong>the legislature through the direction given <strong>of</strong> lateyears to the current <strong>of</strong> judicial decision." 1S<strong>The</strong> Bill as <strong>in</strong>troduced conta<strong>in</strong>ed, however, someclauses relat<strong>in</strong>g to specific performance which evokedconsiderable opposition both <strong>in</strong> Engl<strong>and</strong> <strong>and</strong> <strong>India</strong>.Indeed this opposition brought about the resignation<strong>of</strong> Lord Romilly <strong>and</strong> his colleagues <strong>in</strong> 1870 <strong>and</strong> theContract Bill rema<strong>in</strong>ed before the Legislative Councilfrom 1867 to 1872.Dur<strong>in</strong>g this period the Commission's draft appearsto have been " revised <strong>and</strong> <strong>in</strong> parts elaborated by theLegislative Department <strong>of</strong> <strong>India</strong>. <strong>The</strong> borrow<strong>in</strong>g fromthe New York draft Code seems to belong to thisphase. Lastly, Sir James Stephen made or supervisedthe f<strong>in</strong>al revision, <strong>and</strong> added the <strong>in</strong>troductory def<strong>in</strong>itions,which are <strong>in</strong> a wholly different style <strong>and</strong> notaltogether <strong>in</strong> harmony with the body <strong>of</strong> the work." 19<strong>The</strong> sections borrowed from the draft Civil Code <strong>of</strong>New York were described by Sir Frederick Pollock as" an <strong>in</strong>fliction which the sounder lawyers <strong>of</strong> that Statehave been happily successful so far <strong>in</strong> avert<strong>in</strong>g fromits citizens."
