158 <strong>The</strong> <strong>Common</strong> <strong>Law</strong> <strong>in</strong> <strong>India</strong>an attempt implies <strong>in</strong>tention <strong>in</strong> action. " An attemptis an overt act. It differs from the attempted crime<strong>in</strong> this, that the act has failed to br<strong>in</strong>g the desiredresult." 8 To constitute an attempt at common lawthere has to be an overt act as well as mens rea.Any overt act <strong>of</strong> preparation committed after the<strong>in</strong>tention to commit the crime has been formed <strong>and</strong>tended towards the commission <strong>of</strong> it is an attemptto commit it. In any case, when the connectionbetween the overt act <strong>of</strong> preparation <strong>and</strong> the commission<strong>of</strong> the crime is clear, the fact that the attempthas been frustrated does not prevent it from creat<strong>in</strong>ga crim<strong>in</strong>al liability. It has been sometimes urged thaton pr<strong>in</strong>ciple an attempt which could not possiblysucceed should not be regarded as a crim<strong>in</strong>al attempt<strong>and</strong> should not be punishable. It would, however,now appear well established that the impossibility <strong>of</strong>performance does not per se render the attemptharmless. In Engl<strong>and</strong> it appears that many attemptsto commit crimes are themselves treated as crimes,special punishments be<strong>in</strong>g provided for them. When,however, this is not so, an attempt to commit a crimeis treated as a misdemeanour at common law.<strong>The</strong> <strong>India</strong>n Code conta<strong>in</strong>s a chapter deal<strong>in</strong>g with" attempts " to commit <strong>of</strong>fences. Under the <strong>India</strong>nCode attempts to commit <strong>of</strong>fences are sometimes madecrimes by the provision deal<strong>in</strong>g with the commission<strong>of</strong> the <strong>of</strong>fence itself. One may illustrate this by areference to the <strong>of</strong>fence <strong>of</strong> wag<strong>in</strong>g war aga<strong>in</strong>st theGovernment <strong>of</strong> <strong>India</strong>.
