196 <strong>The</strong> <strong>Common</strong> <strong>Law</strong> <strong>in</strong> <strong>India</strong><strong>The</strong> House <strong>of</strong> Lords has expressly decided that thisjurisdiction extends to quasi judicial as well as thejudicial functions. 31<strong>The</strong> position <strong>of</strong> the ord<strong>in</strong>ary courts <strong>in</strong> <strong>India</strong> <strong>in</strong>respect <strong>of</strong> the decisions <strong>of</strong> adm<strong>in</strong>istrative bodies orpersons entrusted with statutory powers has beenexpla<strong>in</strong>ed by the Privy Council. 32 It has stated thatwhen such decisions are challenged the exclusion <strong>of</strong> thecivil courts is not to be readily <strong>in</strong>ferred from a statute.Such exclusion must either be explicitly expressedor clearly implied. Even <strong>in</strong> cases where the statuteexcludes the jurisdiction <strong>of</strong> the courts the courtscan exam<strong>in</strong>e <strong>in</strong>to cases where the statute has notbeen complied with or the statutory tribunal hasnot acted <strong>in</strong> conformity with the fundamental pr<strong>in</strong>cipleunderly<strong>in</strong>g judicial procedures.<strong>The</strong> Constitution <strong>of</strong> 1950 has <strong>in</strong> this matter takena notable step forward. Hav<strong>in</strong>g <strong>in</strong>cluded a Bill <strong>of</strong>Rights <strong>in</strong> the Constitution the Constitution-makershad necessarily to provide remedies for the enforcement<strong>of</strong> these rights. <strong>The</strong>y also envisaged a welfarestate with its <strong>in</strong>evitable accompaniment <strong>of</strong> a mass<strong>of</strong> parliamentary <strong>and</strong> subord<strong>in</strong>ate legislation whichwould <strong>in</strong>volve constant <strong>in</strong>terference with the normalactivities <strong>of</strong> the citizen.
