(J) Place of Engagement. The theatre location may not be designated as theplace of engagement except where the Actor’s bona fide residence prior toauditioning is in the vicinity of the theatre.23. DEPUTIES.Deputies of Equity shall be permitted in each company. Whenever a Chorus isemployed, there shall be Deputies for Chorus Singers <strong>and</strong> for Chorus Dancers, inaddition to a Deputy for Principal <strong>Actors</strong>.Deputies of Equity must be elected <strong>and</strong> functioning at all times in each company. Therehearsal may be extended no more than 15 minutes to compensate for the time usedfor the election.In the event the Deputy leaves the company or resigns as Deputy, a new Deputyelection must be held immediately <strong>and</strong> is to be called <strong>and</strong> conducted by either theoutgoing Deputy or the Stage Manager.After any Deputy election the appropriate Equity office shall be immediately notified bythe newly elected Deputy of the results of said election, preferably by telephone.24. DISCRIMINATION.(A) The parties hereto affirm their commitment to a policy of nondiscriminationwith respect to equal employment opportunity hereunder on thebasis of gender, race, color, creed, national origin, age, disability, sexualorientation or political persuasion or belief. A claimed violation of this section,unless satisfactorily resolved between Equity <strong>and</strong> the Producer, shall besubmitted to arbitration. In the event the arbitrator determines that discriminationhas been practiced, he shall have the authority to direct reinstatement ofemployment, as the case may be, <strong>and</strong>/or assess such monetary damages, not toexceed contractual salary lost, as in his opinion will make the Actor or applicantwhole for such financial loss as he may have suffered by reason of saiddiscrimination.(B) The Actor shall not be permitted to perform in any theatre or other place ofperformance where, in the opinion of Equity <strong>and</strong> the Producer, discrimination ispracticed on the basis of gender, race, color, creed, national origin, age,disability, sexual orientation or political persuasion or belief against any Actor, oragainst any patron as to admission or to seating in such theatre or other place ofperformance.(C) The Producer <strong>and</strong> Equity agree that employment hereunder is subject tothe provisions of the Fair Employment Practices Act <strong>and</strong> any <strong>and</strong> all FederalStatutes <strong>and</strong> laws relative to discrimination in employment.(D) In order to insure equal employment opportunities for all <strong>Actors</strong>, theProducer shall hold Principal <strong>and</strong> Chorus auditions pursuant to Rule 5(AUDITIONS).32
