<strong>Agreement</strong> are on strike or are picketing the Producer; or (2) for refusal to crossa picket line or enter upon the premises of an employer, other than the Producerif the employees of such employer are engaged in a strike ratified by arepresentative of such employees, which such employer is required by law torecognize. However in either instance, such strike or picketing must enjoy thesanction of <strong>and</strong> be ratified by the relevant parent national or international union.Further the Council of Equity must endorse <strong>and</strong> support the strike or picketing.Equity must direct its members to honor such picket line or strike. The strike orpicketing must not be in violation of the law.(B) The Producer shall not lock out any of the <strong>Actors</strong>, <strong>and</strong> neither the <strong>Actors</strong>nor Equity will call, sanction, or participate in a strike during the period of the<strong>Agreement</strong> between Equity <strong>and</strong> the <strong>Musical</strong> <strong>Stock</strong> <strong>and</strong> <strong>Unit</strong> Attraction Producersexcept as provided above. In no event shall any Actor be required to perform, orto enter the theatre for such purpose, if such performance or entrance wouldendanger the Actor's safety.(C) Should a strike by the <strong>Actors</strong> occur during the period of the <strong>Agreement</strong>,Equity will be deemed not to have violated the terms of this Rule if Equity refrainsfrom assisting, encouraging, or condoning <strong>and</strong> in good faith takes everyreasonable means to terminate the strike at once, <strong>and</strong> in addition thereto,promptly declares publicly that the strike is unauthorized <strong>and</strong> directs the <strong>Actors</strong> tocease such conduct.(D) The provisions of this Rule shall not be deemed to affect the expressrights of Equity or the Actor under Rule 8 (BREACHES BY THE PRODUCER),Rule 21 (DEFAULTING PRODUCERS), Rule 38 (MILITARY SERVICE OF THEACTOR), or Rule 47 (PRODUCTION PROSECUTED OR SUBJECT OFLAWSUIT, CIVIL OR CRIMINAL).40. NON-PROFESSIONALS. (This rule does not apply to <strong>Unit</strong> <strong>Attractions</strong>.)(A) Except in <strong>Unit</strong> <strong>Attractions</strong>, the Producer may employ Non-Professionalswho are not members of any branch of the 4A's, provided they are residents ofthe community in which the theatre is located. Promptly after selection of nonprofessionalsto be added to the production <strong>and</strong> before rehearsals begin, theProducer shall send to Equity a list of those selected with a description of howthey will be used on stage.In addition, such Non-Professionals must qualify in one of the followingcategories:(1) Persons prominent in civic <strong>and</strong> community affairs, who may appearin only one production during the season;(2) Pre-established local organized groups (i.e. a church choir, danceschool group, etc.). A predetermined number of the members of such agroup may be selected for participation, but any auditions held for thatpurpose shall be open only to that membership. Further, such group44
