for the ninth performance shall be at the rate of 2/8ths of contractual salary. Noother penalties shall apply even if the ninth performance is given on the normallyscheduled Full Day Off provided the following conditions are met:(1) the Actor is notified at the time of contract signing;(2) the Actor, in addition to the regular Daylight Day of Rest, receives aFull Day Off, free of travel, rehearsal <strong>and</strong> performance in the weekcontaining seven performances (this Full Day Off may not count as theGolden Day);(3) the Actor shall have no less than one Daylight Day of Rest duringthe nine-performance week.(4) the schedule does not result in a violation of the limitation of notmore than five performances in three days.(J) Rest Period Between Performances. On a two-performance day thereshall be a minimum of one hour rest exclusive of half-hour between any twoperformances. If it is necessary for the cast to leave the theatre in order to obtaina meal, the rest period shall be increased to 1½ hours exclusive of half-hour callbetween performances. Should there be less than one <strong>and</strong> 1½ hours exclusive ofhalf-hour call between performances, <strong>and</strong> there is no suitable/moderately priceddining facility on the theatre premises, the Producer shall, at his own expense,provide the Actor with a meal at the theatre within 15 minutes of the conclusion ofthe first performance. If requested by the Actor at the beginning of theengagement, special dietary needs shall be accommodated. <strong>Actors</strong> shall beoffered a choice of a hot or cold balanced meal. A choice of beverage shall beincluded. The cast shall be notified 24 hours in advance of what the meals willconsist. If there is less than one <strong>and</strong> 1½ hours exclusive of half-hour call betweenperformances <strong>and</strong> there is no dining facility on the theatre premises <strong>and</strong> theProducer does not provide a meal, the Producer shall pay to each Actor apenalty of $7.50 <strong>and</strong> shall notify the Actor 24 hours in advance that a meal willnot be provided. In no event shall the rest period between performances be lessthan one hour.45. PERFORMANCES LOST.(A) If the company as a whole cannot perform because of fire, accident,strikes, riot, Act of God, or the public enemy, which could not be anticipated orprevented, then the Actor shall not be entitled to any salary for the time duringwhich his services shall not for such reason or reasons be rendered. Should anyof the foregoing conditions continue for a period of <strong>10</strong> days or more, either partymay terminate the contract, <strong>and</strong> the Producer will pay for all services to date <strong>and</strong>transportation back to the Actor's residence as given to the Producer prior tosigning of the contract, which address shall conform to that registered withEquity.However, such <strong>Actors</strong> shall be paid full contractual salary for the lostperformances if other employees, whose employment is based directly upon the48
