<strong>10</strong>/27/08 to<strong>10</strong>/25/09<strong>10</strong>/26/09 to<strong>10</strong>/31/<strong>10</strong>$849 to $1,697 YES YES$1,698 to $2,546 YES NO$2,547 <strong>and</strong> above NO* NO*$875 to $1,749 YES YES$1,750 to $2,624 YES NO$2,625 <strong>and</strong> above NO* NO** <strong>Actors</strong> whose Performance Salary is more than 300% of the minimumwho are paid minimum salary during rehearsal may opt out of theProducer provided housing during the rehearsal period <strong>and</strong> receive thefull Per Diem to apply toward housing of their choice.(2) Each Actor is entitled to a private room <strong>and</strong> is to be offered achoice of at least two single-occupancy, air-conditioned livingaccommodations, at least one choice of which has a private bath, notrestricted to one location, which the Producer warrants <strong>and</strong> guaranteeswill be clean, sanitary <strong>and</strong> reputable. YMCA's <strong>and</strong>/or YWCA's, <strong>and</strong>university or college dormitories may not be included as an acceptablechoice.(3) A "private" room is defined as: (a) one which can be locked fromboth the inside <strong>and</strong> outside (i.e., a private hotel room or individualapartment; or (b) a room within an apartment or suite with a door whichcan be secured (closed <strong>and</strong>/or locked) to ensure privacy, withoutrestricting the access of any other Actor sharing the premises to the bath<strong>and</strong>, when applicable, any kitchen <strong>and</strong>/or living room.(4) The Producer shall ensure that there are reasonableaccommodations when a performer with a disability is engaged.(5) The accommodations offered for the Actor's choice must bedescribed as to price, equipment (such as telephone, kitchen, TV, etc.),services, types of beds, smoking <strong>and</strong> non-smoking accommodations,distance from the theatre, availability of public transportation, <strong>and</strong> theproximity of shopping <strong>and</strong> laundry services, post office <strong>and</strong> health club.The Producer shall supply Equity with a copy of the list of housinglocations being recommended to <strong>Actors</strong>.(6) The Actor shall not be called for transportation to rehearsal untilsaid Actor has secured housing in accordance with this Rule, but in noevent earlier than 1½ hours after the Actor's arrival at lodging reserved forhim. Any invasion of the specified 1½ hours is payable at the Overtimerate to each Actor involved.38
