I. INTRODUCTION<strong>New</strong> <strong>York</strong> <strong>State</strong> enacted Executive Law, Article 36-A (L.1994, c.170) creating the<strong>New</strong> <strong>York</strong> Motor Vehicle Theft and Insurance Fraud Prevention Demonstration Programto help reduce the overall cost <strong>of</strong> motor vehicle insurance in the <strong>State</strong>. A 12-memberMotor Vehicle Theft and Insurance Fraud Prevention Board was authorized underthis statute to oversee the program. Members <strong>of</strong> the Board, selected by the Governorand the Legislature, include representatives <strong>of</strong> law enforcement, consumers <strong>of</strong> motorvehicle insurance, insurance carriers, and relevant state agencies. The Board becameoperational in September <strong>of</strong> 1997 with the appointment <strong>of</strong> its members. This is the 13 thannual report to the Governor and the Legislature by the <strong>New</strong> <strong>York</strong> Motor Vehicle Theftand Insurance Fraud Prevention Board as required under Executive Law §846-1(3)(h).Funding for the program isprovided for under <strong>State</strong> FinanceLaw §89-d which established aspecial fund consisting <strong>of</strong> moniesreceived from the $10 dollar feeassessed on each insurance policyissued for a portion <strong>of</strong> passengervehicles and all other motor vehiclesregistered in <strong>New</strong> <strong>York</strong> <strong>State</strong>Insurance Law §9110.
