HOUGHTON,Secretary.20th September, 1927.WESTERN AUSTRALIAN GOVERNMENT RAILWAYS.IT is hereby notified, for general information, that His Excellencythe Governor in Executive Council has been pleasedto approve of the following By-law being issued by the Commissionerof Railways, pursuant to Sections 23 and 24 of" The Government Railways Act, 1904 "By-law No. 83Regulations and Charges for the hire ofMooring ,Springs.All vessels berthing at any of the jetties or wharves underthe control of the Commissioner of Railways, at which mooringsprings are provided by the Harbour and Light Departmentshall, for the safe bet-thing of such vessels, use suchmooring springs.The Officer in charge shall decide the number of springsto be used by any vessel and, should it appear to hintnecessary at any time, may order additional springs to beused.The springs will be available on the jetty, from whichposition the vessel will pick them up, and a receipt for sameshall be given by or on behalf of the master of the vessel tothe Officer in charge.The master of the vessel using the springs will be responsiblefor the laying of the springs and replacing same afteruse, failing which, the Department shall be empowered toreplace same at the expense of the master of the vessel.No officer or servant of the Department, or other person,unless otherwise directed by the Officer in charge of thejetty, or wharf, or berthing operations, shall be allowed tohalt or walk within twelve feet of any bollard, or any otherplace under the jurisdiction of the Department to which anymooring spring or rope may be made fast.The Commissioner will not be responsible in regard topersons or vessels for any loss, damage, or accident fromwhatever cause arising in consequence of the mooring springsbeing permitted to lie on the jetty.The Commissioner will not be responsible for any damagedone to any vessel, or damage or loss caused by any vesselto any other vessel, thing, or person arising from the defectivecondition of any spring or springs provided by the Department.The master, owner, or agent of any vessel using the springsshall be responsible :(a.) for the maintenance of such springs whilst in hisor their possession ;(b.) shall replace such springs after use, to the Department,in good order and condition ;(e.) shall pay for the damage caused to the springs,from whatever cause arising.Thirty shillings (30s.) per spring, per day or part thereof,shall be charged for the use of each spring, and shall be payableby the master, owner, or agent of the vessel to the Commissioneron behalf of the Harbour and Light Department.Every vessel when shifting berth shall be responsible forthe removal to the new berth of the mooring springs then inuse. Should this course not be pursued, however, the vesselin question may be held responsible for replacing the springsin use at the time of shifting berth.h September, 1027.APPO FNTMENI'H.
