7 MARCH <strong>2012</strong> SRI LANKA<br />

―Thereafter, the officers of police Crime Investigation Division (CID) detained him at an<br />

unknown location, which he believes could be in Wattala.<br />

―While being detained, the suspect said, CID officers hanged him from the legs and<br />

tortured using clubs.<br />

―In his petition suspect Thyagarajah Prabhakaran requests the Court to order the<br />

authorities to release him as he is being detained without being charged for two years<br />

and ten months.<br />

―The Supreme Court noted that the allegations raised in the petition are of very serious<br />

nature.<br />

―After considering his appeal, the Supreme Court ordered the Attorney General to<br />

submit a report on the possibility of releasing the suspect on 08 <strong>March</strong>, or to file charges<br />

against him.‖<br />

8.51 On 19 January <strong>2012</strong> the same source 167 reported that:<br />

―The main suspect in the murder of Sri Lankan Former Foreign Minister Lakshman<br />

Kadirgamar [who was killed in Colombo in August 2005] informed courts that he was<br />

tortured while in police custody to extract a confession.‖<br />

―One policeman beat the suspect's head with poles and his ear drum was burst<br />

following assault by the other, the suspect claimed.<br />

―As a result, he told court that his hearing is partially impaired.<br />

He told the judge that information about his torment has already been conveyed to the<br />

Colombo magistrate and the judicial medical officer.‖<br />

8.52 The website of the Asian Human Rights Commission (AHRC) regularly reports on<br />

incidents and allegations of torture .The AHRC also produced a document, entitled<br />

Police torture case, Sri Lanka, 1998 - 2011, dated 24 June 2011, providing details of<br />

323 cases of torture related to that period of time.<br />

Extra-judicial killings<br />

8.53 The USSD 2010 report 168 noted that:<br />

―There were reports that the government or its agents committed arbitrary or unlawful<br />

killings, but reliable statistics on such killings by the government or its paramilitary allies<br />

were difficult to obtain because past complainants were killed and families feared<br />

reprisals if they filed complaints. Among these arbitrary and unlawful killings, a number<br />
