Seatbelts and Restraints<br />

Wearing seatbelts is compulsory, not a choice. Modern cars are<br />

fitted with seatbelts for all seats, including rear seats. They must<br />

be used.<br />

Seatbelts must be worn by people in a motor vehicle when it<br />

is moving or is stationary, but not parked. A person must not<br />

occupy a seat without a seatbelt if o<strong>the</strong>r seats with seatbelts are<br />

available.<br />

Passenger’s responsibilities<br />

Passengers aged 16 years old or older commit an offence in any<br />

moving motor vehicle if <strong>the</strong>y:<br />

• do not wear <strong>the</strong> seatbelt when a seatbelt is available<br />

• sit in <strong>the</strong> front row of seats if <strong>the</strong>re is no seatbelt available, unless<br />

– <strong>the</strong> vehicle has only one row of seats, or<br />

– <strong>the</strong>re is no seat available in ano<strong>the</strong>r row.<br />

Driver’s responsibility<br />

Drivers commit an offence if <strong>the</strong>y fail to wear a seatbelt when one is<br />

available.<br />

Drivers (except <strong>the</strong> driver of a bus or motorcycle rider) also commit an<br />

offence if passengers are not wearing a seatbelt or child restraint.<br />

Drivers must ensure children:<br />

Up to <strong>the</strong> age of six months<br />

• Use an approved rearward-facing infant restraint and must not travel<br />

in <strong>the</strong> front seat of a vehicle that has two or more rows of seats.<br />

6 months to 4 years<br />

• Use ei<strong>the</strong>r an approved rearward-facing infant restraint or a forwardfacing<br />

child safety seat an inbuilt harness and must not travel in <strong>the</strong><br />

front seat of a vehicle that has two or more rows of seats.<br />

4 years up to 7 years<br />

• Use ei<strong>the</strong>r an approved forward-facing child safety seat with an<br />

inbuilt harness, or booster seat with a properly fastened and<br />

adjusted lap-sash seatbelt or child safety harness.<br />

• Must not travel in <strong>the</strong> front seat of a vehicle that has two or more<br />

rows of seats, unless all <strong>the</strong> o<strong>the</strong>r seats are occupied by children<br />

who are also under 7 years.<br />

7 years up to 16 years<br />

• must wear a seatbelt (or child restraint) if one is available<br />

• must wear a seatbelt before any passengers aged 16 or over.<br />

Always use restraints that are Australian Standards approved, correctly<br />

installed and adjusted to fit <strong>the</strong> child’s body.
