12 Diferències d’adjudicaci<strong>ó</strong><br />
L’article 126.1.e) <strong>de</strong>l TRLUC estableix:<br />
“e) Les diferències d’adjudicaci<strong>ó</strong> han d’ésser objecte <strong>de</strong> compensaci<strong>ó</strong> econòmica entre les persones<br />
interessa<strong>de</strong>s, el valor <strong>de</strong> la qual s’ha <strong>de</strong> fixar atenint-se al preu <strong>de</strong> les parcel·les resultants que els haurien<br />
correspost si l’adjudicaci<strong>ó</strong> hagués estat possible”.<br />
Segons l’article 139.3 <strong>de</strong>l RLUC:<br />
“139.3 Excepci<strong>ó</strong> feta <strong>de</strong>l supòsit previst per l'apartat 2.a) <strong>de</strong> l'article anterior, i llevat d'acord entre les<br />
persones propietàries afecta<strong>de</strong>s, en el projecte <strong>de</strong> reparcel·<strong>laci</strong><strong>ó</strong> no es po<strong>de</strong>n fer adjudicacions que<br />
exce<strong>de</strong>ixin el 15% <strong>de</strong>ls drets <strong>de</strong> les persones adjudicatàries.”<br />
Les diferencies d’adjudicaci<strong>ó</strong> s<strong>ó</strong>n objecte <strong>de</strong> compensaci<strong>ó</strong> econòmica entre els interessats.<br />
Les diferencies d’adjudicaci<strong>ó</strong> figuren en el Compte <strong>de</strong> Liquidaci<strong>ó</strong> Provisional.<br />
