MULTITUDE OF DEBTORS
AND CREDITORS IN
LIABILITY

Pursuant to the Article 455 of the Civil Code of Georgia, if several persons
are authorized to request the fulfillment of liability in a form, where each of
them can request absolute fulfillment and where the debtor is obliged to
fulfill it only once, they can be referred as solidery authorized persons –
Solider creditors.
In accordance with the Article 463 of the same Code, if several persons
are obliged to fulfill their liability in a form, where each of them should
participate in the fulfillment of the common liability (solider liability), and
the creditor is authorized to file as single request on fullfillment, then they
represent solider debtors.
According to the law, these types of legal relations are referred as multitude
of creditors and debtors in liability.
Similar types of legal relations are also covered by the Roman Civil Law
and as a result of its processing, modern civil law of Continental Europe and
the civil legislation of the Continental European states were developed. Our
country joined these laws on November 25, 1997, immediately after the Civil
Code of Georgia entered into force.
In order to better realize the contents of legal relations, it is necessary to
study the grounds and sources that after processing and development served
as the bases for the establishment of legal system in its current form.
The presented paper serves the same purpose.
