peraturan terkait, Penjual tersebut harus segera berhenti
menggunakan layanan yang disediakan oleh JD.ID; apabila
Penjual melanjutkan untuk menggunakan layanan yang
disediakan oleh JD.ID, termasuk namun tidak terbatas
pada mengunggah informasi barang, menerima pesanan
dan memperbarui informasi yang telah dipublikasikan,
maka akan dianggap bahwa Penjual telah menerima
Ketentuan Layanan atau peraturan terkait yang telah
diperbaiki.
Pasal IV
Penanganan Pelanggaran
4.1 Apabila Penjual melanggar kewajiban perlindungan hak
dan kepentingan konsumen sebagaimana telah diatur di
dalam Syarat dan Ketentuan Umum, Ketentuan
Perlindungan Konsumen ini atau Ketentuan Platform
JD.ID terkait dan dengan demikian menyebabkan
keluhan(-keluhan) dari Konsumen(-Konsumen), Penjual
wajib secara aktif menangani keluhan(-keluhan); apabila
Penjual gagal untuk menangani dengan baik keluhan(-
keluhan) dan menyebabkan ekskalasi keluhan(-keluhan)
atau kegagalan penanganan keluhan(-keluhan) sesuai
dengan peraturan yang disetujui yang disediakan di atas,
JD.ID memiliki hak untuk memeriksa materi pembuktian
yang disediakan oleh Konsumen dan oleh Penjual
berdasarkan pengetahuan perorangan biasa. JD.ID
memiliki hak untuk menuntut Penjual untuk
melaksanakan kewajiban terkait dengan segera dan
bertanggung jawab mengenai hal terkait, atau
mengkompensasi konsumen terlebih dahulu, apabila
ditentukan bahwa Penjual gagal untuk melaksanakan
kewajiban yang disetujui di atas secara benar.
4.2 Apabila JD.ID mengkompensasi konsumen terlebih dahulu
dari Penjual, Penjual wajib melengkapi jumlah yang sesuai
dan membayar ganti rugi yang sesuai dengan Perjanjian
Layanan, Ketentuan Layanan ini atau Ketentuan Platform
JD.ID terkait. Apabila Penjual gagal untuk melengkapi
jumlah tersebut, JD.ID memiliki hak untuk mengurangi
jumlah yang sesuai dari pembayaran oleh Penjual yang
belum selesai; apabila pembayaran yang belum selesai itu
tidak cukup untuk mengganti rugi kerugian JD.ID, JD.ID
memiliki hak untuk mencari kompensasi lebih jauh dari
Penjual.
4.3 Apabila terdapat perjanjian lain apapun mengenai
tanggung jawab atas pelanggaran kewajiban
perlindungan hak dan kepentingan konsumen di dalam
Syarat dan Ketentuan Umum dan Ketentuan Platform
JD.ID, perjanjian itu yang akan berlaku.
Pasal V
Tanggung Jawab Terbatas
5.1 Penjual wajib menjadi pelaksana kewajiban untuk
perlindungan hak dan kepentingan Konsumen, dan JD.ID
tidak akan menanggung tanggun jawab untuk
using the services provided by JD.ID; if the Seller
continues using the services provided by JD.ID,
including but not limited to uploading the goods
information, accepting orders and updating the
publicized information, it shall be deemed that the
Seller has accepted the revised Terms of Service or
relevant rules.
Article IV
Handling of Breaches
4.1 If the Seller violates the obligation of protecting
consumers’ rights and interests as stipulated in the
General Terms and Conditions, this Terms of
Consumer Protection or relevant JD.ID Platform Rules
and thus causes complaint(s) of Customer(s), the
Seller shall actively handle the complaint(s); if the
Seller fails to properly handle the complaint(s) and
causes the escalation of the complaint(s) or fails to
handle the complaint(s) according to the agreed rules
provided above, JD.ID has the right to review the
evidence materials provided by the Customer and by
the Seller according to the knowledge of ordinary
persons. JD.ID has the right to demand the Seller to
perform the relevant obligations immediately and
assume the relevant liabilities, or compensate the
consumer in advance, if it determines that the Seller
fails to properly perform the obligations agreed
above.
4.2 If JD.ID compensates the consumer in advance of the
Seller, the Seller shall complement the corresponding
amount and pay the corresponding liquidated
damages in accordance with the Service Agreement,
this Terms of Service or the relevant JD.ID Platform
Rules. If the Seller fails to make the complement of
amount, JD.ID has the right to deduct the
corresponding amount from the unsettled payments
of the Seller; if the unsettled payments are insufficient
to compensate for the losses of JD.ID, JD.ID reserves
the right to seek further compensation from the
Seller.
4.3 If there is any other agreement on the liabilities for
breaching the obligation of protecting consumers’
rights and interests in the General Terms and
Conditions and the JD.ID Platform Rules, such
agreement shall prevail.
Article V
Limited Liability
5.1 The Seller shall be the subject of liability for protection
of consumers’ rights and interests, and JD.ID shall not
bear the liability for protection of consumers’ rights
