Art. 6<br />
The parties acknowledge, as stated above, that the real estates referred to<br />
in this document are subject to historical-artistic duties, therefore this<br />
purchase must be reported to the Ministry of cultural heritage and<br />
environmental conservation, in accordance with article 59 of Legislative<br />
Decree 42/2004, in relation to the pre-emption carried out by the same<br />
Ministry.The parties acknowledge that the purchase is subject to the<br />
condition precedent of the pre-emption not implemented by the Ministry of<br />
cultural heritage and environmental conservation. The sellers engage in<br />
serving the aforementioned Ministry with this document within the time<br />
limits laid down by law, upon receiving all necessary copies.The condition<br />
precedent on which the purchase is based is understood to be verified<br />
when the 60-day time limit has uselessly passed since the report, or the<br />
Ministry has bindingly declared its intention to renounce the pre-emption.<br />
No other fulfilment will be requested to this end, by following the ipso-iure<br />
deadline; nevertheless, in order to warn the third parties that this<br />
condition has come into being, the buyers will be able to make it known<br />
through a public or private certified document, to be copied or recorded<br />
with full legal effect. To this purpose, the sellers hereby authorise the<br />
buyers to stipulate the aforementioned document even without their<br />
participation, in accordance with article 1395 of the Civil Code, exempting<br />
the Keeper of real estate records from all responsibilities as of now for each<br />
related record. Should the Ministry implement the pre-emption, this<br />
purchase will be definitively invalid and ineffective and the sellers will<br />
engage in returning the amounts received by the buyers within three days<br />
since the pre-emption.The expenses related to this document, consequent<br />
and interconnected, are and will be attributed to the buyer.<br />

the notary, made known by reading it to the appearing parties who,<br />
consulted by me, declared it to comply perfectly with their will and they<br />
sign it at …………….<br />
