(1) Judge advocates. All judge advocates will receive training at initial military legal and periodic refresher training<br />

(a) DOD and <strong>Army</strong> sexual assault response policies: confidentiality policy rules and limitations.<br />

1. Use of “restricted” reports by command, investigative agencies, trial and defense counsel.<br />

2. Relationship of “restricted” reports to MRE.<br />

(b) Victim rights.<br />

1. Familiarity with Victim/Witness Assistance Program.<br />

2. Victim and Witness Assistance Program challenges in the deployed environment.<br />

(c) Victimology.<br />

1. Victimization process.<br />

2. Victim responses: trauma and post traumatic stress disorder.<br />

3. Understanding sex offenders.<br />

(d) Recantations and false information.<br />

(e) Deployment issues: remote location assistance and Victim and Witness Assistance Program.<br />

(2) Judge advocate trial counsel and military defense counsel. All trial and military defense counsel (that is, military<br />

judge advocate prosecutors at courts-martial) will receive initial and periodic refresher training, when required based on<br />

their position, on the following essential tasks:<br />

(a) Sexual assault response policies.<br />

1. DOD.<br />

2. Service specific.<br />

3. DOD confidentiality policy rules and limitations.<br />

(b) Evidence.<br />

1. Forensic and scientific-working knowledge of: Sexual Assault Examination Kit, basic forensic photography, and<br />

lab results.<br />

2. Rules of evidence-MRE 412, 413, and 615 and case law concerning the admission of expert testimony (scientific<br />

and nonscientific).<br />

(c) Interviewing, trial preparation, and cross-examination skills.<br />

1. Victim.<br />

2. Lay witnesses.<br />

3. Expert witness.<br />

(d) Sexual assault victim preparation for interviews, depositions and testimony.<br />

g. Chaplains. All chaplains will receive initial and periodic refresher training on the following essential tasks:<br />

(1) Sexual assault response policies.<br />

(a) DOD<br />

(b) <strong>Army</strong> prevention and response policy.<br />

(c) Privileged communications and confidentiality policy rules and limitations.<br />

(2) Victimology.<br />

(a) Types of assault.<br />

(b) Health consequences.<br />

1. Mental/spiritual health.<br />

2. Physical health.<br />

(c) Myths and facts.<br />

(d) Secondary victimization.<br />

(e) Cultural/religious differences.<br />

(3) Victim rights.<br />

(4) Trauma training with pastoral applications.<br />

(a) Types of injury.<br />

(b) Consulting/referral process.<br />

(5) Documentation.<br />

(6) Permissible reporting of information to command and others.<br />
