authority or when the victim does not or cannot consent. Sexual assault includes rape, nonconsensual sodomy (oral or<br />
anal sex), indecent assault (unwanted, inappropriate sexual contact or fondling), or attempts to commit these acts.<br />
Sexual assault can occur without regard to gender or spousal relationship or age of victim. “Consent” will not be<br />
deemed or construed to mean the failure by the victim to offer physical resistance. Consent is not given when a person<br />
uses force, threat of force, or coercion or when the victim is asleep, incapacitated, or unconscious.<br />
Single parent<br />
A Soldier who is the responsible adult who by reason of birth or legal decree, has physical custody of and the legal and<br />
moral responsibility to provide for the care and Well-being of a child under the age of 19 years or for a person beyond<br />
19 years of age who is mentally or physically incapable of self care. Persons who fit this category are generally<br />
regarded as parents with full or joint custody of children, and who are unmarried, divorced, widowed, or residing apart<br />
from their spouse.<br />
Site<br />
A physically defined location which can be supported by a legal boundary survey which closes a polygon. It can be<br />
owned, leased, or otherwise possessed or used. A site may exist in one of three forms: land only; facility or facilities<br />
only; or land and all facilities on it. A site is a sum of all real property at a specific location.<br />
Spouse<br />
The husband or wife of a Soldier. If such person is also in the military Service, see the term, “dual military couple.”<br />
Subject<br />
Refers to the subject of a complaint.<br />
Supported commander<br />
In the context of the support command relationship, the commander who receives assistance from another commander’s<br />
force or capabilities, and who is responsible for ensuring that the supporting commander understands the assistance<br />
required.<br />
Supporting commander<br />
In the context of a support command relationship, the commander who aids, protects, complements, or sustains another<br />
commander’s force, and who is responsible for providing the assistance required by the supported commander.<br />
Uniformed Service<br />
The <strong>Army</strong>, Navy, Air Force, Marine Corps, Coast Guard, the Commissioned Corps of the Public Health Service, and<br />
the Commissioned Corps of the National Oceanic and Atmospheric Administration.<br />
Unrestricted reporting<br />
Unrestricted reporting allows a Soldier who is sexually assaulted and desires medical treatment, counseling, and an<br />
official investigation of his/her allegation to use current reporting channels (for example, the chain of command or law<br />
enforcement), or he/she may report the incident to the S<strong>AR</strong>C or the on-call VA. Upon notification of a reported sexual<br />
assault, the S<strong>AR</strong>C will immediately notify a VA. Additionally, with the victim’s consent, the healthcare provider will<br />
conduct a forensic examination, which may include the collection of evidence. Details regarding the incident will be<br />
limited to only those personnel who have a legitimate need to know. (See appendix H for a detailed explanation of<br />
restricted and unrestricted reporting.)<br />
Virtual installation<br />
Two types of “virtual” installations exist within the <strong>Army</strong>. The <strong>AR</strong>NG has virtual installations, identified as each state<br />
commanded by the Adjutant General, under which are Readiness Centers or sites. <strong>Army</strong> Reserve Support <strong>Command</strong>s<br />
are, likewise, defined as virtual installations under which Reserve Centers are identified as sites.<br />
