The Fundamental Law of the Spanish State, “Fuero de los<br />
Espagnoles,” adopted on July 17, 1945, authorized only the<br />
private practice of non-Catholic religions, and forbid any<br />
type of propaganda of “false” religions.<br />
In fact, Art. 6, paragraph 1 states:<br />

«The profession and practice of the Roman<br />
Catholic religion, which is that of the Spanish<br />
State, will enjoy official protection,»<br />
and in paragraph 2:<br />
«No one will be disturbed for their religious beliefs,<br />
nor for the private practice of their faith.<br />
No other ceremonies nor public manifestations<br />
will be permitted other than those of the<br />
Catholic religion.»<br />
Following <strong>Vatican</strong> <strong>II</strong>, however, the “Organic Law of the<br />
State” (January 10, 1967) replaced paragraph 2 of Art. 6<br />
with this disposition:<br />
«The State will assume the protection of religious<br />
freedom, which will be guaranteed an<br />
equal judicial protection and safeguard of the<br />
moral and public order.»<br />
Furthermore, the Preamble to the “Charter of the Spanish<br />
People”, modified by the above-mentioned Organic Law,<br />
explicitly states that:<br />
«… given the changes introduced in article 6 of<br />
the Organic Law of the State, ratified by national<br />
referendum, with the purpose of adapting<br />
the text to the Council’s Declaration on<br />
“Religious Freedom,” promulgated on December<br />
7, 1965, and requesting the explicit recogni-
