15.38 We make no equivalent recommendation for the magistrates’ court: if the<br />

magistrates th<strong>in</strong>k either that a conviction would be unsafe, or merely that the<br />

<strong>in</strong>crim<strong>in</strong>at<strong>in</strong>g evidence has been so weakened by evidence <strong>of</strong> collusion or<br />

contam<strong>in</strong>ation that they cannot be sure the accused committed the <strong>of</strong>fence, they<br />

will acquit.<br />
