Interest shall be charged at SBI’s PLR rate +0.5% - 25% against mechanical completion of dismantling and erection activities of stack and convections sections including insitu joints cross over pipes welding and completion in all respects and on certification by HPCL/ consultant nominated by HPCL. - 10% against completion of balance works including complete documentation and on issue of completion certificate by HPCL/ consultant nominated by HPCL. - Transportation charges shall be paid after completion of all the transportation activities including dismantled items as specified in the tender documents. - Public sector enterprises and Central / State Govt. departments are exempted from furnishing B.G against advance payment. Payments shall be released with in 7 days from the date of invoice and certification of invoice by HPCL/ consultant nominated by HPCL. All payments will be made in "e-payment", Vendor to submit necessary e-payment mandate. 7.0 SCHEDULE OF LUMPSUM PRICE. 7.1 All prices shall be quoted in Indian Rupees only. 7.2 The lump sum price quoted shall be for the complete scope of work. 7.3 Prices shall be quoted strictly in accordance with the price schedule Proforma - V and VI 7.4 Price break up quoted as per Proforma – VI. 7.5 Prices shall be firm and fixed for the completion of the total scope of work as per the contract. No escalation is permitted on the quoted rates through out the completion period on account of any variation in the price of material, cost of labour or any other reason. 7.6 Tenderer shall consider all the terms and conditions, technical commercial, scope of work, site conditions, time schedule for the entire scope of work and quote accordingly. 7.7 The lump sum price quoted by the tenderer shall include any other item and any other work not specifically mentioned in the tender document but necessary for completion of the job No extra claims what so ever will be entertained. 7.8 Prices shall be quoted both in figures and words.
21 8.0 LIQUIDATED DAMAGES. i. In case of any delay in completion of fabrication and supply of convection sections, stack sections and other associated items beyond the contractual delivery of 5 months, the owner shall be entitled to be paid liquidated damages by the contractor. The liquidated damages shall be initially at the rate of 1% (one percent) of the total supply value for every week of delay subject to a maximum of 5% of the total supply value. The liquidated damages shall be recovered by the owner out of the amounts payable to the contractor or from any Bank Guarantees or deposits furnished by the contractor or the Retention money retained from the Bills of the contractor, either under this contract or any other contract. ii. In case of any delay in completion of erection of convection sections, stack sections and associated items during shut down period beyond the contractual delivery of 20 days, the owner shall be entitled to be paid liquidated damages by the contractor. The liquidated damages shall be at the rate of 1% (one percent) of the total erection value for every day of the delay subject to a maximum of 5% of the total erection value. The liquidated damages shall be recovered by the owner out of the amounts payable to the contractor or from any Bank Guarantees or deposits furnished by the contractor or the Retention money retained from the Bills of the contractor, either under this contract or any other contract. iii. The contractor shall be entitled to give an acceptable unconditional Bank Guarantee in lieu of such a deduction if contractor desires any decision on a request for time extension. iv. This final calculation of LD shall be only on the value of the unexecuted portion / quantity of work as on the CDD. v. Contractor agrees with the owner, that the above represents a genuine preestimate of the damages, which the owner will suffer on account of delay in the performance of the work by Contractor. The contractor further agrees that the LD amount is over and above any right which owner has to risk purchase under clause 12.4 of G.T.C enclosed and any right to get the defects in the work rectified at the cost of the contractor. The above clause is applicable instead of clause no: “10” of the G.T.C. 9.0 SECURITY DEPOSIT The Tenderer with whom the contract is decided to be entered in to and intimation is so given will have to make a security deposit of one percent (1%) of the total contract value in the form of account payee crossed demand draft drawn in favour of HPCL payable at Visakhapatnam, with in 15 days from the date of intimation of acceptance of the tender, failing which, HPCL reserves the right to cancel the contract and forfeit the EMD. 1% of PO/contract value as security deposit will be acceptable in the form of Demand draft upto Rs.50,000/- and in the form of demand draft/ Bank guarantee beyond Rs.50,000/- Composite PBG for 10% of PO value towards security deposit and performance bank guarantee shall be accepted: which shall be valid upto a period of 3 months beyond the expiry of Defect liability period. Demand draft should be drawn on Scheduled Banks, other than Co-operative Banks. 10.0 RETENTION MONEY 10% of the total value of the running account and final bill will be deducted and retained by HPCL as retention money on account of any damage / defect liability
