pyipper his pleyet sum Springis throw yis burt to ye Miscontentment of sum honest Nich bours<br />

and irritating of yame provoking to gryt anger ye Inhabitants of yis burt & apperandlie liklie to<br />

breid greter siditioun wtin yis burt – Thairfoir his suspendit & discharget ye said Anthoni fra<br />

using of his comoun office throw yis burt in ye evenig & Mornig ay & qll he get a New warrand<br />

fra ye provost Baillies C’sall & Dekynis of Craftis for ysing yrof– And forder inhibits ye said<br />

Anthoni to play that spring call’d ‘Tabacco’ or ‘The Laird tint his gunflet’ under qtsoever vyr<br />

name Ither privislie in Menis houss or publictlie upon ye streittis at any time heirafter under ye<br />

pane of banishment –<br />

Quhilk day the provost Baillies & C’sall of ye burt of Dundie being Convenit in the Counsall<br />

house thairof Viz (All the Several Members Councill) for Nominatioun and Electioun of ye New<br />

Counsall of ye said burt for ye zeir to cum & forme to ane decrit Arbitral Proceed be certane<br />

Ministers & Comissionaris of the burrows anent the forme of ye Electioun of ye said burt<br />

Zeirlie in tyme Cumig of ye dait at Perth ye Sevent of Julii last bypast comperet James Low<br />

One of the C’sall for ye Craftes & in name of ye said hail Craftes (As he declares) dissentit to<br />

all poytis off ye foirsad Decriet And All that May Follow Yrupon qlk may prejudge any Richt<br />

libertie privilige & Imunitie grantit to ye Free Craftsmen of ye said burt under Dekynirie or if<br />

any of yame And any tyme befoir ye dait heirof. And yrupon askit Actis – And William Hill ane<br />

uyr of the C’sall for the said Craftes Lykwayes dissassented to the said decriet.<br />

Decimo nono die Mensis Septembris 1604<br />

Qhlk day he provost Baillies and Council being convenit in ye C’sall house t’rof for Electioun<br />

of ye New C’sall of ye said burt – Comperet Robert Goldman collector of ye Craftes ye Zeir<br />

p’cedig and for himself & in name of ye Dekynes of Craftis of ye said burt – Declaring yt yae<br />

haid dene Nething in yr tymes preicudiciall to the stait of ye said Craftis And thurfoir In caiss<br />

Ony thing precudiciall to yr Ancient privilidges be done in ye Electioun of ye C’sall &<br />

Magistrates at yis tyme p’testit yt yai may be frie yrof & yrupon askit Actis.<br />

The foirsaid Day Robert Flescher Baillie diclaird that the Electioun of the council and<br />

Magistrates should be conforming to the decreat Arbitral pronounced by the amicable friends<br />

chosen betwixt Sir James Scrmzuor of Dudhop Knicht, Wm Auchinleck Baillie and Certain of<br />

the Counsell for themselves and taking burden for the remanent counsel and Deacons of<br />

Crafts on the one part & the said Robert Flescher and certain other their assenters on the<br />

other part of the date the day of July last by past – And likways conforming to the Acts<br />

of parliament wherunto the said decreit is relative viz The 29 Act of the 5 parl’t of King James<br />

3d And to the Lve Act of the 7 th par’t of he same King – And in case the provost baillies and<br />

Coun’s proced to Elect other ways nor is preseryvet to the said Decreit and Acts foresaid<br />

protested for Remedy and Reduction.<br />

The same day compeared Wm Auchinleck Baillie and asked Act that Robert Flescher Baillie<br />

affirmed that the Crafts said that they had an Warrant to have four of their number upon the<br />

Council.<br />

Anent the desire made by the collector and Deacons of Crafts on the said Burgh Craving that<br />

four of their number may be of the Council of the said Burgh conforming to some Ancient<br />

Rights which they alledge has been granted to them and their predecessors – The foirsaid<br />

provost Baillies and Council has answered that because the foresaid Rights are not known to<br />

them that presently not agree to the said desire but that they will keep to them their privilidges<br />

thereof they are in possession reserving to the said Crafts their rights giff any be as accords.<br />

The provost and Baillies after long reasoning Anent the number that Should be upon the<br />

Council concluded that their be only twelve persons whereof ten of the Gild and two of the<br />

crafts by and outour the Provost and Baillies Treasurer and dean of Gild that shall be elected<br />
