2d day of january 1668<br />

James Smith Sword Slipper for a riot committed against Alice Yeaman, Dr of medicine under<br />

silence of night, at the burrial of the Ladie Rieriss – and of his disobedience, and unseemly<br />

behaviour to the magistrates and Also in consideration of his standing under Several Acts of<br />

Banishment – they ytherefore ordainit “that the sd James Smith, his wyfe bairnes & familie be<br />

banishit the toune, and yt he continue in waird qll his wyfe & bairnes, remove ymselves & that<br />

he be punishet, by the stoks, or ur wayes the Magistrates sall think expedient &c &c And to be<br />

Whipped, & receive the townes burning marke upon him as a Notorious Malefactor.”<br />

6 February 1668<br />

This entry relative an Action at law, offerred to Submission and also “that there is an offer<br />

made for the Ross’s to give ym a little moey to stop yr mouthes” – which the Council left to the<br />

Law to decide &c &c.<br />

17 February 1668<br />

The Provost declared that in obedience to a l’re from George Forrester he sent over in a<br />

closed l’re wt Thomas Nicol to him – King James 6 his Charter in favours of the toune for<br />

attending the p’sones action.<br />

14 April 1668<br />

The Council upon a Petition from James Smith out of ther, cosideran & pitie toward his poore<br />

childre, gratit him, libertie to return – Provyding he p’snt himself first befor them - & make his<br />

ignemious cofessun of his former fault & promises ammendment of his lyfe in tyme coing.<br />

2 July 1668<br />

The Councill Ordained - That the Schoolars loft in the West Kirk, be inlargit & buildit from the<br />

Baxters Seat to the sd Seat, & that the entry yrof be by that same passage that the remanent<br />

lofts of the West Syde of the Kirk is - & that the old passage be stopt, & seats built up in the<br />

trance yrof.<br />

The Council also considering that the Hospital Seat in the sd Kirk is far off from the pulpit, so<br />

that the men cannot heare the Minister, They ordayne, that ther seat in the sd West Kirk be<br />

liftit from thence to the east Kirk & yt the same be set up betwixt Craigies Seat, and Ansra’ll to<br />

both, as sall be best contryvit.<br />
