Section 2-8. Adapted language education <strong>for</strong> pupils from language m<strong>in</strong>orities<br />

Pupils attend<strong>in</strong>g the primary and lower secondary school who have a mother tongue other<br />

than Norwegian or Sami have the right to adapted education <strong>in</strong> Norwegian until they are<br />

sufficiently proficient <strong>in</strong> Norwegian to follow the normal <strong>in</strong>struction of the school. If<br />

necessary, such pupils are also entitled to mother tongue <strong>in</strong>struction, bil<strong>in</strong>gual subject<br />

teach<strong>in</strong>g, or both.<br />

The mother tongue <strong>in</strong>struction may be provided at a school other than that normally<br />

attended by the pupil.<br />

When mother tongue <strong>in</strong>struction and bil<strong>in</strong>gual subject teach<strong>in</strong>g cannot be provided by<br />

suitable teach<strong>in</strong>g staff, the municipality shall as far as possible provide <strong>for</strong> other <strong>in</strong>struction<br />

adapted to the pupils’ abilities.<br />

pursuant to the Decree of 2 July 2004 no. 1064).<br />

Section 2-9. School rules, etc.<br />

The municipality shall issue regulations concern<strong>in</strong>g school rules <strong>for</strong> <strong>in</strong>dividual primary and<br />

lower secondary schools. The rules shall set out the rights and obligations of the pupils<br />

<strong>in</strong>sofar as these are not laid down by law or <strong>in</strong> other ways. The rules shall <strong>in</strong>clude rules <strong>for</strong><br />

conduct, the measures that may be used aga<strong>in</strong>st pupils who break the rules and the<br />

procedure <strong>for</strong> deal<strong>in</strong>g with such matters.<br />

The school rules shall be made known to the pupils and the parents. The requirements<br />

stated <strong>in</strong> section 38, first paragraph (c) of the Public Adm<strong>in</strong>istration <strong>Act</strong> concern<strong>in</strong>g<br />

publication <strong>in</strong> the Norwegian Legal Gazette do not apply.<br />

Corporal punishment or other humiliat<strong>in</strong>g <strong>for</strong>ms of treatment must not be used.<br />

Be<strong>for</strong>e tak<strong>in</strong>g any decision concern<strong>in</strong>g discipl<strong>in</strong>ary action, <strong>in</strong>clud<strong>in</strong>g exclusion from<br />

<strong>in</strong>struction, the pupil shall be given an opportunity to present his or her case orally to the<br />

person responsible <strong>for</strong> tak<strong>in</strong>g a decision.<br />

Section 2-10. Exclusion from the teach<strong>in</strong>g<br />

The municipality may lay down <strong>in</strong> the school rules that pupils attend<strong>in</strong>g grades 8–10 who<br />

are guilty of serious or repeated violation of the rules may be excluded from teach<strong>in</strong>g <strong>for</strong><br />

up to three days, and that pupils attend<strong>in</strong>g grades 1–7 may be excluded from the teach<strong>in</strong>g<br />

<strong>for</strong> <strong>in</strong>dividual periods or <strong>for</strong> the rest of the day.<br />

The decision on exclusion from the teach<strong>in</strong>g is made by the head teacher him/herself after<br />

consult<strong>in</strong>g the pupil’s teachers. Be<strong>for</strong>e such a decision is made, other remedial or<br />

discipl<strong>in</strong>ary measures shall have been considered. The parents of pupils attend<strong>in</strong>g grades<br />

1–7 shall be notified be<strong>for</strong>e such pupils are excluded from the teach<strong>in</strong>g <strong>for</strong> the rest of the<br />

day.
