The apprenticeship contract or tra<strong>in</strong><strong>in</strong>g contract may be resc<strong>in</strong>ded by the parties if they<br />

are agreed on this and after the county authority has been <strong>in</strong><strong>for</strong>med <strong>in</strong> writ<strong>in</strong>g by the<br />

tra<strong>in</strong><strong>in</strong>g establishment.<br />

With the consent of the county authority the contract may be resc<strong>in</strong>ded both by the<br />

tra<strong>in</strong><strong>in</strong>g establishment and by the apprentice or tra<strong>in</strong><strong>in</strong>g candidate if:<br />

(a) the other party is guilty of serious breaches of his or her duties connected with work,<br />

(b) the apprentice, tra<strong>in</strong><strong>in</strong>g candidate or tra<strong>in</strong><strong>in</strong>g establishment proves to be <strong>in</strong>capable of<br />

cont<strong>in</strong>u<strong>in</strong>g the apprenticeship, or<br />

(c) the apprentice or tra<strong>in</strong><strong>in</strong>g candidate declares <strong>in</strong> writ<strong>in</strong>g that it would be an<br />

unreasonable <strong>in</strong>convenience <strong>for</strong> him or her to cont<strong>in</strong>ue until the end of the contractual<br />

period.<br />

The county authority decides <strong>in</strong> such cases when the apprenticeship shall cease. The<br />

tra<strong>in</strong><strong>in</strong>g establishment shall issue a certificate <strong>for</strong> the completed part of the contractual<br />

period with a statement about this part of the tra<strong>in</strong><strong>in</strong>g.<br />

If the contract is voluntarily resc<strong>in</strong>ded by the apprentice or tra<strong>in</strong><strong>in</strong>g candidate, the right to<br />

upper secondary education and tra<strong>in</strong><strong>in</strong>g pursuant to section 3-1 ceases to apply unless<br />

the county authority decides otherwise. When a decision is made to resc<strong>in</strong>d the contract at<br />

the request of the tra<strong>in</strong><strong>in</strong>g establishment, the right of the apprentice or tra<strong>in</strong><strong>in</strong>g candidate<br />

to upper secondary education and tra<strong>in</strong><strong>in</strong>g cont<strong>in</strong>ues to apply unless the decision<br />

stipulates that it shall cease to apply.<br />

Be<strong>for</strong>e tak<strong>in</strong>g a decision concern<strong>in</strong>g rescission at the request of the tra<strong>in</strong><strong>in</strong>g establishment<br />

or be<strong>for</strong>e tak<strong>in</strong>g a decision concern<strong>in</strong>g loss of rights, the apprentice or tra<strong>in</strong><strong>in</strong>g candidate<br />

shall be given an opportunity to present his or her case orally to the person responsible <strong>for</strong><br />

tak<strong>in</strong>g a decision.<br />

With the consent of the county authority the apprenticeship period may be <strong>in</strong>terrupted by<br />

leave of absence.<br />

If the tra<strong>in</strong><strong>in</strong>g establishment is discont<strong>in</strong>ued or no longer fulfils the conditions <strong>for</strong> approval<br />

pursuant to section 4-3, or if the county authority f<strong>in</strong>ds that the tra<strong>in</strong><strong>in</strong>g is not satisfactory,<br />

the county authority shall try to procure new placements <strong>for</strong> the apprentices or tra<strong>in</strong><strong>in</strong>g<br />

candidates <strong>for</strong> the rema<strong>in</strong>der of the contract period. The new tra<strong>in</strong><strong>in</strong>g establishment enters<br />

<strong>in</strong>to the contract <strong>in</strong> the <strong>for</strong>mer establishment’s stead. With the consent of the county<br />

authority, the contract period <strong>in</strong> the new establishment may be extended by up to one year<br />

if tra<strong>in</strong><strong>in</strong>g has been <strong>in</strong>adequate.<br />

The apprenticeship contract or tra<strong>in</strong><strong>in</strong>g contract may not be amended or resc<strong>in</strong>ded <strong>in</strong> any<br />

other way than <strong>in</strong> accordance with this section. Exceptions apply to apprentices who have<br />

a probationary period pursuant to section 4-5, third paragraph.<br />
