Chapter 5. Special education<br />

Section 5-1. The right to special education<br />

Pupils who either do not or are unable to benefit satisfactorily from ord<strong>in</strong>ary teach<strong>in</strong>g have<br />

the right to special education.<br />

In assess<strong>in</strong>g what k<strong>in</strong>d of <strong>in</strong>struction shall be provided, particular emphasis shall be<br />

placed on the pupil’s developmental prospects. The content of the courses offered shall<br />

be such that the pupil receives adequate benefit from the <strong>in</strong>struction as a whole <strong>in</strong> relation<br />

to other pupils and <strong>in</strong> relation to educational objectives that are realistic <strong>for</strong> the pupil.<br />

Pupils who receive special education shall have the same total number of teach<strong>in</strong>g hours<br />

as other pupils, cf. sections 2-2 and 3-2.<br />

Section 5-3. Expert assessment<br />

Be<strong>for</strong>e the municipality or the county authority takes a decision concern<strong>in</strong>g special<br />

education pursuant to section 5-1, or a decision concern<strong>in</strong>g special educational assistance
