deviate from these standards, the school must be able to document that the environment<br />

nevertheless has a satisfactory effect on the health, well-be<strong>in</strong>g and learn<strong>in</strong>g of the pupils.<br />

All pupils are entitled to a workplace adapted to their needs. The school shall be equipped<br />

to provide <strong>for</strong> the needs of the pupils at the school who have disabilities.<br />

If a pupil or parent, or one of the councils or committees at the school where such are<br />

represented, requests measures to correct physical environmental conditions, the school<br />

shall as soon as possible consider the matter <strong>in</strong> accordance with the provisions<br />

concern<strong>in</strong>g <strong>in</strong>dividual decisions laid down <strong>in</strong> the Public Adm<strong>in</strong>istration <strong>Act</strong>. If the school<br />

has not made a decision <strong>in</strong> the matter with<strong>in</strong> a reasonable time, an appeal may<br />

nevertheless be brought pursuant to the provisions of the Public Adm<strong>in</strong>istration <strong>Act</strong> as if<br />

an <strong>in</strong>dividual decision had been made.<br />

Section 9a-3. The psychosocial environment<br />

The school shall make active and systematic ef<strong>for</strong>ts to promote a good psychosocial<br />

environment, where <strong>in</strong>dividual pupils can experience security and social belong<strong>in</strong>g.<br />

If any school employee learns or suspects that a pupil is be<strong>in</strong>g subjected to offensive<br />

language or acts such as bully<strong>in</strong>g, discrim<strong>in</strong>ation, violence or racism, he or she shall<br />

<strong>in</strong>vestigate the matter as soon as possible and notify the school leaders and, if necessary<br />

and possible, <strong>in</strong>tervene directly.<br />

If a pupil or parent requests measures concern<strong>in</strong>g the psychosocial environment, <strong>in</strong>clud<strong>in</strong>g<br />

measures aga<strong>in</strong>st offensive behaviour such as bully<strong>in</strong>g, discrim<strong>in</strong>ation, violence or racism,<br />

the school shall as soon as possible deal with the matter pursuant to the provisions<br />

concern<strong>in</strong>g <strong>in</strong>dividual decisions laid down <strong>in</strong> the Public Adm<strong>in</strong>istration <strong>Act</strong>. If the school<br />

has not assessed the matter with<strong>in</strong> a reasonable time, an appeal may nevertheless be<br />

brought pursuant to the provisions of the Public Adm<strong>in</strong>istration <strong>Act</strong> as if an <strong>in</strong>dividual<br />

decision had been made.<br />

Section 9a-4. Systematic ef<strong>for</strong>ts to promote the health, environment and safety of the<br />

pupils (<strong>in</strong>ternal control)<br />

The school shall actively make cont<strong>in</strong>uous and systematic ef<strong>for</strong>ts to promote the health,<br />

environment and safety of the pupils <strong>in</strong> order to meet the requirements laid down <strong>in</strong> or<br />

pursuant to this chapter. The school management is responsible <strong>for</strong> the day-to-day<br />

implementation of this. Such ef<strong>for</strong>ts shall apply to both the physical and the psychosocial<br />

environment.<br />
