case under consideration, to attend a meeting <strong>of</strong> the Tribunal.<br />

(d) The Dean <strong>of</strong> <strong>College</strong> shall present the case against the student before the<br />

Disciplinary Tribunal and/or the Governing Body. The Dean <strong>of</strong> <strong>College</strong> shall be<br />

present during the proceedings <strong>of</strong> these bodies, and may participate in the<br />

discussion <strong>of</strong> a case, until such times as the Chairperson requests her/him to<br />

withdraw. The Dean <strong>of</strong> <strong>College</strong> shall not be present while the Tribunal and the<br />

Governing Body are considering and taking their decision.<br />

(e) If the Disciplinary Tribunal or the Governing Body are satisfied that the procedure<br />

laid down in section 6(a)(i) has been carried out, they may proceed to hear and<br />

decide upon the case in the absence <strong>of</strong> the student accused <strong>of</strong> an <strong>of</strong>fence, even if<br />

the student has failed to appear when required to do so under section 6(c).<br />

(f) The Tutor <strong>of</strong> the student concerned (or her/his advocate) shall be present during the<br />

proceedings <strong>of</strong> the Disciplinary Tribunal and/or Governing Body until such times<br />

as the Chairperson requests her/him to withdraw. The Tutor may participate in the<br />

discussion <strong>of</strong> a case, unless the student concerned, having appeared at the hearing,<br />

has declined to give the Tutor authority under the provision <strong>of</strong> section 6(a)(vii).<br />

The Tutor shall not be present while the Tribunal and the Governing Body are<br />

considering and taking their decision.<br />

(g) The Disciplinary Tribunal shall reach decisions on disciplinary matters by a simple<br />

majority vote. In cases <strong>of</strong> equality <strong>of</strong> votes the Chairperson shall have an<br />

additional casting vote.<br />

(h) In the event that the Disciplinary Tribunal is given reasons to think that the student<br />

may be guilty <strong>of</strong> a major <strong>of</strong>fence, additional to that with which he/she is first<br />

charged, the procedure for the Tribunal, as described in this Ordinance shall begin<br />

afresh in respect <strong>of</strong> the new charge with a written statement to the student from the<br />

Dean <strong>of</strong> <strong>College</strong> <strong>of</strong> the alleged new <strong>of</strong>fence.<br />

(i) Members <strong>of</strong> the Disciplinary Tribunal may participate in the proceedings <strong>of</strong> the<br />

Governing Body, but shall not be present when the Governing Body consider and<br />

take their decisions.<br />

(j) The Governing Body shall reach decisions on disciplinary matters by a simple<br />

majority <strong>of</strong> those present and eligible to vote under the terms <strong>of</strong> the Ordinance,<br />

except that a decision to remove a student finally from the <strong>College</strong> shall require the<br />

support <strong>of</strong> two thirds <strong>of</strong> those present and eligible to vote under the terms <strong>of</strong> this<br />

Ordinance. In cases <strong>of</strong> equality <strong>of</strong> votes, the Chairperson <strong>of</strong> the Governing Body<br />

shall have an additional casting vote.<br />

7. CONFIDENTIALITY<br />

All members <strong>of</strong> the Disciplinary Tribunal shall be required not to disclose information<br />

concerning any meetings <strong>of</strong> the Tribunal, whether in the form <strong>of</strong> documents, oral<br />

evidence, or otherwise, except at a meeting <strong>of</strong> the Governing Body.<br />
