Environmental documents must be prepared in accordance with CEQ regulations and FHWA regulations and guidelines for implementing NEPA. The Federal Land Policy and Management Act (FLPMA) of 1976, as amended will require transfer of an interest in land, the nature of which is to be determined, for right-of-way across some BLM lands for which compensation has not yet been determined by BLM. To the extent that the Mineral Leasing Act of 1920 applies, the Project will conform to its requirements. Permits to cross ARRC-owned land, including Government Hill greenbelt, and Harvard Park are required; permit to place viaduct piers within the ARRC rail yard are also required. Tideland and submerged land easements authorize use of State land for commercial and noncommercial purposes. A permit to fill and grade in a Municipality of Anchorage-platted ROW or public easement may be required. Public easement and rights-of-way (ROW) are required for construction. For projects occurring within the Port MacKenzie District, a use permit may be required, together with a voluntary Acknowledgement of Existing Land Use regulations. The project complies with NEPA, CEQ regulations, and FHWA regulations and guidelines. Consultation and coordination of impacts related to the BLM-owned land on Elmendorf Air Force Base was conducted with the BLM and the U.S. Air Force in accordance with the Mineral Leasing Act and FLPMA. Further coordination will occur during the permitting and design phase. Consultation and coordination of impacts related to ARRC-owned land was conducted with ARRC and the Municipality of Anchorage in accordance with permitting requirements. Coordination of impacts related to easements on tidelands and submerged land was conducted with the ADNR, DMLW in accordance with the land management requirements. Consultation and coordination of impacts related to ROW acquisition was conducted with Municipality of Anchorage. Coordination of impacts related to land use and ROW acquisition was conducted with the Mat-Su Borough. Cultural Environment E.O. 11593, Protection and Enhancement of the Cultural Environment National Historic Preservation Act (NHPA), Section 106, 16 U.S.C. § 470 FHWA Agency Description EIS Findings/Compliance Permits Required Alaska Department of Transportation and Public Facilities (ADOT&PF) USEPA FHWA, USDOT FHWA, USDOT FHWA, USDOT FHWA ADOT&PF FHWA ADNR, Office of History and Archeology, State Historic Preservation Office (SHPO) E.O. 12898 mandates that each federal agency shall make achieving environmental justice part of its mission by identifying and addressing disproportionately high and adverse human health and environmental effects of its programs, policies, and activities on minority and low-income populations. Title VI prohibits discrimination on the basis of race, color, and national origin in programs and activities receiving federal financial assistance. USEPA regulates airborne pollutants from project construction activities and project operation. The project must have an approved Air Quality Conformity determination in carbon monoxide maintenance areas. The project must be included in Municipality of Anchorage’s Long-Range Transportation Plan (LRTP). The project must be included in Municipality of Anchorage’s Transportation Improvement Program (TIP). Requires agencies that must use private property to acquire it at fair market value and assist in any necessary relocation of residents or businesses. E.O. 11593 specifies that federal agencies provide leadership in preserving and maintaining the historic and cultural environment of the nation, directing policy for maintenance and preservation of federally owned sites and encouraging the preservation of nonfederally owned sites. Section 106 of the NHPA requires that federal agencies take into account impacts to historic properties (i.e., archaeological, cultural, and historic sites listed in or eligible for inclusion in the National Register of Historic Places) and afford an opportunity for the SHPO, the Advisory Council on Historic Preservation as appropriate, and consulting parties an opportunity to review and consult on identification and evaluation of historic properties potentially affected by federally funded or federally permitted projects. Implementation of Knik Arm Crossing (KAC) Project would not have a disproportionately adverse effect on minority or low-income populations. Coordination of impacts related to air quality was conducted with Alaska Department of Environmental Conservation (ADEC) and the MOA in accordance with the CAA. The LRTP amendment with the inclusion of the KAC project and air quality conformity was approved by the Anchorage Metropolitan Area Transportation Solutions (AMATS) Policy Committee on April 12, 2007. The Municipality’s Transportation Improvement Program amendment and accompanying Air Quality Conformity determination was approved by the AMATS Policy Committee on June 27, 2007. All property owners, without discrimination, will be compensated for their loss of property at fair market value, and all displaced persons will be moved at no expense. Relocations will be conducted in accordance with the Uniform Relocation Assistance and Real Property Acquisition Policies Act of 1970 and the Alaska Relocation Assistance and Real Property Acquisition Practice, as amended, and relocation assistance will be made available to all businesses and residential property owners affected by the project. Consultation with the Government Hill Community Council, Anchorage Historic Properties, the Knik Tribe, the Native Village of Eklutna, and the Alaska Office of History and Archaeology was conducted for the project to identify and evaluate potential effects to historic properties. A Memorandum of Agreement to address adverse effects in accordance with Section 106 of NHPA is being finalized.
