Chapter 7 Caldicott Guardian, In<strong>for</strong>mation Shar<strong>in</strong>g and Record Keep<strong>in</strong>g<br />
This section:<br />
Provides general pr<strong>in</strong>ciples <strong>for</strong> <strong>in</strong><strong>for</strong>mation shar<strong>in</strong>g.<br />
Gives details of the role of the Caldicott Guardian.<br />
Provides l<strong>in</strong>ks to professional codes of conduct and <strong>guidance</strong>.<br />
In<strong>for</strong>mation Shar<strong>in</strong>g<br />
Healthcare staff have a duty to share <strong>in</strong><strong>for</strong>mation when a <strong>child</strong> or young person<br />
may be at risk of significant harm. This will always override a professional or<br />
agency requirement to keep <strong>in</strong><strong>for</strong>mation confidential. In<strong>for</strong>mation should be<br />
disclosed only <strong>for</strong> the purpose of protect<strong>in</strong>g <strong>child</strong>ren and young people and<br />
there<strong>for</strong>e should be relevant and proportionate and shared promptly and<br />
effectively when necessary. Healthcare staff should seek their professional<br />
bodies <strong>guidance</strong> if unsure.<br />
In<strong>for</strong>mation shar<strong>in</strong>g <strong>for</strong> <strong>child</strong> <strong>protection</strong> – general pr<strong>in</strong>ciples:<br />
The safety, welfare and wellbe<strong>in</strong>g of a <strong>child</strong> or young person are of central<br />
importance when mak<strong>in</strong>g decisions to lawfully share <strong>in</strong><strong>for</strong>mation with or<br />
about them.<br />
Children and young people have a right to express their views and have<br />
them taken <strong>in</strong>to account when decisions are made about what should<br />
happen to them.<br />
The reasons why <strong>in</strong><strong>for</strong>mation needs to be shared and particular actions<br />
taken should be communicated openly and honestly with <strong>child</strong>ren or<br />
young people, and where appropriate with families.<br />
In general, <strong>in</strong><strong>for</strong>mation will normally only be shared with the consent of the<br />
<strong>child</strong> or young person (depend<strong>in</strong>g on age and maturity). However, where<br />
there are concerns that seek<strong>in</strong>g consent would <strong>in</strong>crease the risk to a <strong>child</strong><br />
or young person or others or prejudice any subsequent <strong>in</strong>vestigation;<br />
<strong>in</strong><strong>for</strong>mation may need to be shared without consent.<br />
At all times, <strong>in</strong><strong>for</strong>mation shared should be relevant, necessary and<br />
proportionate to the circumstances of the <strong>child</strong> or young person, and<br />
limited to those who need to know.<br />
When gather<strong>in</strong>g <strong>in</strong><strong>for</strong>mation about possible risks to a <strong>child</strong> or young<br />
person, <strong>in</strong><strong>for</strong>mation should be sought from all relevant sources, <strong>in</strong>clud<strong>in</strong>g<br />
services that may be <strong>in</strong>volved with other family members. Relevant<br />
historical <strong>in</strong><strong>for</strong>mation should also be taken <strong>in</strong>to account.<br />
When <strong>in</strong><strong>for</strong>mation is shared, a record should be made of when it was<br />
shared, with whom, <strong>for</strong> what purpose, <strong>in</strong> what <strong>for</strong>m and whether it was<br />
disclosed with or without <strong>in</strong><strong>for</strong>med consent. Similarly, any decision not to<br />
share <strong>in</strong><strong>for</strong>mation should be recorded.<br />
Agencies should provide clear <strong>guidance</strong> <strong>for</strong> practitioners on shar<strong>in</strong>g<br />
<strong>in</strong><strong>for</strong>mation. This should <strong>in</strong>clude advice on shar<strong>in</strong>g <strong>in</strong><strong>for</strong>mation about<br />
adults who may pose a risk to <strong>child</strong>ren or young people, deal<strong>in</strong>g with<br />
disputes over <strong>in</strong><strong>for</strong>mation-shar<strong>in</strong>g and clear policies on whistle-blow<strong>in</strong>g.<br />
