Healthcare staff should seek advice if they are not confident about shar<strong>in</strong>g<br />

<strong>in</strong><strong>for</strong>mation. This advice can be obta<strong>in</strong>ed from l<strong>in</strong>e managers, NHS <strong>child</strong><br />

<strong>protection</strong> team or Caldicott Guardian.<br />

Health Professionals will be aware of their duty of confidentiality <strong>in</strong> relation to<br />

one-to-one consultations and <strong>in</strong> relation to written health records or<br />

consultations. However, there will be circumstances where <strong>in</strong><strong>for</strong>mation relat<strong>in</strong>g to<br />

a patient or patients should and can be released without breach<strong>in</strong>g these<br />

pr<strong>in</strong>ciples. Responsibility <strong>for</strong> ensur<strong>in</strong>g that patient-identifiable <strong>in</strong><strong>for</strong>mation rema<strong>in</strong>s<br />

confidential is both an organisational and <strong>in</strong>dividual one. It is the responsibility of<br />

the Caldicott Guardian to facilitate understand<strong>in</strong>g and awareness of that<br />

responsibility and to ensure that all such activities with<strong>in</strong> an organisation are<br />

The Caldicott Guardian:<br />

Can advise on <strong>in</strong>dividual cases where there are any concerns about the<br />

potential <strong>for</strong> the disclosure of patient-identifiable <strong>in</strong><strong>for</strong>mation.<br />

Has a particular responsibility <strong>for</strong> reflect<strong>in</strong>g patients <strong>in</strong>terests regard<strong>in</strong>g the<br />

use of patient identifiable <strong>in</strong><strong>for</strong>mation.<br />

Is responsible <strong>for</strong> ensur<strong>in</strong>g patient identifiable <strong>in</strong><strong>for</strong>mation is shared <strong>in</strong> an<br />

appropriate and secure manner.<br />

Each Health Board will have a Caldicott Guardian who may be:<br />

An exist<strong>in</strong>g member of the management board of the organisation.<br />

A senior health professional.<br />

An <strong>in</strong>dividual with responsibility <strong>for</strong> promot<strong>in</strong>g cl<strong>in</strong>ical governance<br />

with<strong>in</strong> the organisation.<br />

It is particularly important that the Caldicott Guardian has the seniority and<br />

authority to exercise the necessary <strong>in</strong>fluence on policy and strategic plann<strong>in</strong>g and<br />

carry the confidence of his or her colleagues.<br />

All GP or Dental Practices, Opticians and Pharmacists must meet their<br />

<strong>in</strong><strong>for</strong>mation governance obligations. The Medical Director of the a<strong>for</strong>ementioned<br />

may take up the role of Caldicott Guardian. All patients have a right to expect<br />

that:<br />

In<strong>for</strong>mation relat<strong>in</strong>g to them will be properly created and managed.<br />

It will be handled <strong>in</strong> confidence.<br />

Patient-identifiable <strong>in</strong><strong>for</strong>mation will only be shared with those whose<br />

justification <strong>for</strong> receiv<strong>in</strong>g such <strong>in</strong><strong>for</strong>mation has been rigorously tested.<br />

CONFIDENTIALITY<br />

In practice, all patient <strong>in</strong><strong>for</strong>mation, whether held on paper, computer, video or<br />

audio tape, or even when it is simply held <strong>in</strong> the memory of a health professional,<br />

must not normally be disclosed to a third party without the consent of the patient.<br />

This duty applies regardless of age, mental health or capacity.<br />
