113.14 Review <strong>of</strong> Board Decisions:<br />
113.14.1 Any person aggrieved by a decision <strong>of</strong> the BORA,<br />
whether or not a previous party to the decision, may file an<br />
appeal pursuant to Section 553.775(3) (c) Florida Statutes.<br />
Appeals <strong>of</strong> decisions within the review jurisdiction <strong>of</strong> the<br />
Florida Building Commission shall be to the Florida Building<br />
Code in the manner prescribed in the referenced statute.<br />
Review <strong>of</strong> other decisions <strong>of</strong> the Board shall be as provided<br />
in the Florida Rules <strong>of</strong> Appellate Procedure for judicial review<br />
<strong>of</strong> administrative action.<br />
113.15 Amendments to Code<br />
113.15.1 The provisions <strong>of</strong> the South Florida Building Code<br />
Broward Edition, Broward Local Amendments to the FFPC,<br />
and the Florida Building Code as applicable to Broward<br />
County, shall be amended only by the BORA and only to the<br />
extent and in the manner specified in the Code, and in Section<br />
553.73(4), Florida Statutes. For fire code related<br />
amendments see FFPC and section 633.0215 Florida Statutes.<br />
113.15.2 Neither the Board <strong>of</strong> County Commissioners nor<br />
any municipality within Broward County may enact any<br />
ordinance in conflict with Chapter 71-575, as amended, the<br />
Florida Building Code, or the South Florida Building Code<br />
Broward Edition.<br />

STOP WORK ORDER<br />
115.1 Authority Whenever any work is being done in<br />
violation <strong>of</strong> the provisions <strong>of</strong> this Code or is being installed<br />
in a manner that it would create a hazard (unsafe or<br />
dangerous manner) to life or property, the Building Official<br />
or his/her duly authorized representative may order<br />
such work to stopped or may order the violation corrected<br />
within a reasonable period <strong>of</strong> time, by notice in writing<br />
served on the person or persons engaged in the doing or<br />
causing <strong>of</strong> such work to be done. Such person shall immediately<br />
stop such work until provisions have been made<br />
with the Building Official or his/her duly authorized representative<br />
to bring such work into compliance with this<br />
code, at which time the Building Official or his/her duly<br />
authorized representative may authorize the work to proceed.<br />
If the Fire Chief or his/her duly authorized representative<br />
becomes aware <strong>of</strong> a hazardous condition, which presents<br />
immediate danger to life, he/she shall be authorized to order<br />
the hazard removed or remedied immediately, and<br />
shall be empowered to order the closing <strong>of</strong> the building or<br />
place where such danger to life violation exists, until such<br />
time as same has been corrected. Any failure <strong>of</strong> immediate<br />
compliance shall empower the Fire Chief or his/her duly<br />
authorized representative finding such hazardous condi-<br />

tion creating immediate danger to life, to close such building<br />
or cause same to be closed and the people herein<br />
evacuated and barred from reentering until such time as<br />
such immediate danger to life has been corrected. The<br />
Fire Chief or his/her duly authorized representative is given<br />
the authority to order any gas company, power company,<br />
or other utility company, to disconnect its service to<br />
any building or buildings containing gas or power installations,<br />
where such installations, in the opinion <strong>of</strong> the Fire<br />
Chief or his/her duly authorized representative, creates an<br />
immediate danger to life, and to otherwise close or evacuate<br />
such building and to bar reentry thereto, until such installation<br />
is repaired or replaced and such hazard to life<br />
ceases to exist.<br />
Rejections shall include specific reference to the Code<br />
Section upon which rejection is based in writing.<br />
115.2 Issuance. The stop work order shall be in writing and shall<br />
be given to the owner <strong>of</strong> the property involved, or to the owner’s<br />
agent, or to the person doing the work, or posted on the job site<br />
in a conspicuous location. Upon issuance <strong>of</strong> a stop work order,<br />
the cited work shall immediately cease by such persons. The stop<br />
work order shall state the reason for the order, and the conditions<br />
under which the cited work will be permitted to resume.<br />
115.3 Unlawful continuance. Any person who shall continue<br />
any work after having been served with a stop work order, except<br />
such work as that person is directed to perform to remove a<br />
violation or unsafe condition, shall be subject to penalties as<br />
prescribed by law.<br />
SECTION 116<br />
UNSAFE STRUCTURES AND EQUIPMENT<br />
116.1 General.<br />
116.1.1 Buildings or structures that in the opinion <strong>of</strong> the<br />
Building Official are, or hereafter shall become unsafe, unsanitary<br />
or deficient in adequate facilities for means <strong>of</strong><br />
egress, or which constitute a fire or windstorm hazard, or<br />
illegal or improper use, occupancy or maintenance, or which<br />
do not comply with the provisions <strong>of</strong> the applicable Minimum<br />
Housing Code, or which have been substantially damaged<br />
by the elements, acts <strong>of</strong> God, fire, explosion or otherwise,<br />
shall be deemed unsafe buildings and a permit shall be<br />
obtained to demolish the structure or bring the building to<br />
comply with the applicable Codes.<br />
116.1.2 Incomplete buildings or structures commenced<br />
without a permit or the permit for which has expired, or<br />
completed buildings or structures commenced without a<br />
permit or the permit for which expired prior to completion<br />
and no Certificate <strong>of</strong> Occupancy has been issued, shall be<br />
presumed and deemed unsafe.<br />
116.1.3 Unsafe buildings or structures shall be demolished<br />
and removed from the premises concerned, or made safe,<br />
sanitary and secure in a manner required by the Building<br />
Official and as provided in this Chapter, provided that where<br />
replacement, repair, alteration or demolition is required on<br />
2010 FBC — Building 1.47<br />
