3. Assures <strong>the</strong> full protection of residents' rights; <strong>and</strong><br />

4. Promotes <strong>the</strong> social, physical <strong>and</strong> mental well-being of residents.<br />

303 REQUIRED SERVICE AGREEMENT/CONTRACTS<br />

303.1 If a service required under <strong>the</strong>se <strong>regulations</strong> is not provided directly by <strong>the</strong><br />

facility, <strong>the</strong> facility must have a written agreement/contract with an outside<br />

program, resource or service to furnish <strong>the</strong> necessary service.<br />

303.2 A residential long term care facility that admits or retains persons with a diagnosis<br />

of mental illness/disorder in need of active treatment must make arrangements<br />

with a mental health service provider <strong>for</strong> <strong>the</strong> provision of an active treatment plan.<br />

This provision shall apply regardless of <strong>the</strong> size of <strong>the</strong> residential long term care<br />

facility.<br />

304 INSPECTIONS BY DEPARTMENT<br />

304.1 All areas of <strong>the</strong> licensed facility <strong>and</strong> all records related to <strong>the</strong> care <strong>and</strong> protection<br />

of residents, including resident <strong>and</strong> employee records, must be open <strong>for</strong> inspection<br />

by <strong>the</strong> Department <strong>for</strong> <strong>the</strong> purpose of en<strong>for</strong>cing <strong>the</strong>se <strong>regulations</strong>. <strong>The</strong><br />

Department or its agents shall be af<strong>for</strong>ded reasonable access to books <strong>and</strong> papers<br />

relating to <strong>the</strong> facility.<br />

304.2 <strong>The</strong> facility must provide <strong>for</strong> <strong>the</strong> maintenance <strong>and</strong> submission of such statistical,<br />

financial or o<strong>the</strong>r in<strong>for</strong>mation, records or reports, in such <strong>for</strong>m <strong>and</strong> at such time<br />

<strong>and</strong> in such manner as <strong>the</strong> Department may require.<br />

304.3 Facilities must provide a written acceptable plan of correction within 10 days of<br />

receipt of written notification <strong>for</strong> deficiencies found during routine inspections,<br />

special visits <strong>and</strong> complaint investigations;<br />

304.4 <strong>The</strong> facility must post <strong>the</strong> Statement of Deficiencies from <strong>the</strong> latest survey in a<br />

prominent location within <strong>the</strong> facility.<br />

304.5 <strong>The</strong> Director of <strong>the</strong> Office of Long Term Care may assess fines <strong>and</strong> sanctions<br />

against residential long term care facilities as specified in Appendix B of <strong>the</strong>se<br />

<strong>regulations</strong>.<br />

305 FACILITY ADMINISTRATOR REQUIREMENTS<br />

305.1 Each facility must have a full-time (minimum 40 hours per week) administrator<br />

on <strong>the</strong> premises during normal business hours. <strong>The</strong> administrator must have<br />

responsibility <strong>for</strong> daily operation of <strong>the</strong> facility. Correspondence between <strong>the</strong><br />

Office of Long Term Care <strong>and</strong> <strong>the</strong> facility must be through <strong>the</strong> administrator.<br />

305. 2 <strong>The</strong> administrator must not leave <strong>the</strong> residential care facility premises during <strong>the</strong><br />

day tour of duty without first delegating authority to a qualified individual who<br />

will manage <strong>the</strong> facility temporarily during <strong>the</strong> administrator's absence.<br />
