n. An entry shall be made at any time <strong>the</strong> resident's status changes or in <strong>the</strong> event of an<br />

unusual occurrence. This documentation shall include:<br />

a. Falls;<br />

b. Illness;<br />

c. Physician visits;<br />

d. Any problem with staff members or o<strong>the</strong>rs;<br />

e. Any hospitalization;<br />

f. Any physical injury sustained, whatever <strong>the</strong> circumstances;<br />

g. Changes in <strong>the</strong> resident's condition;<br />

o. A copy of <strong>the</strong> completed assessment <strong>for</strong>m done by a mental health service provider as<br />

appropriate.<br />

p. A copy of court orders or letters of guardianship, if applicable.<br />

q. Discharge date.<br />

313.2 <strong>The</strong> facility must maintain <strong>the</strong> resident's records in <strong>the</strong> <strong>following</strong> manner:<br />

a. Each resident shall have <strong>the</strong> right to inspect his/her records during normal business hours<br />

unless contraindicated by <strong>the</strong> attending physician;<br />

b. <strong>The</strong> facility must not disclose any resident records maintained by <strong>the</strong> facility to any<br />

person or agency o<strong>the</strong>r than <strong>the</strong> facility personnel or <strong>the</strong> Office of Long Term Care<br />

except upon expressed written consent of <strong>the</strong> resident, unless <strong>the</strong> disclosure is required by<br />

state or federal law or regulation;<br />

c. Each facility must provide a locked file cabinet or locked room <strong>for</strong> keeping resident's<br />

medical, social, personal <strong>and</strong> financial records;<br />

d. <strong>The</strong> facility must maintain (on paper, microfilm, etc.) <strong>the</strong>se records in an accessible<br />

manner <strong>for</strong> a period of five (5) years <strong>following</strong> <strong>the</strong> death or discharge of a resident.<br />

400 SERVICES<br />

Nothing in <strong>the</strong>se <strong>regulations</strong>, in this part or any o<strong>the</strong>r, shall be construed to require a residential care facility to<br />

provide services at no charge that are not included in <strong>the</strong> basic daily rate or monthly charge listed in <strong>the</strong><br />

admission agreement/ contract.<br />
