a. During any medical examination or health related consultations <strong>the</strong> resident may have at<br />

<strong>the</strong> facility;<br />

b. During visitations with o<strong>the</strong>r persons;<br />

c. In written, verbal <strong>and</strong> telephone communications;<br />

d. In <strong>the</strong> resident's room or <strong>the</strong> resident's portion of <strong>the</strong> room. Staff of a facility shall not<br />

enter a resident's room without making <strong>the</strong>ir presence known, except in an emergency;<br />

e. In <strong>the</strong> conduct of <strong>the</strong> resident's personal affairs;<br />

f. In visual privacy in tub, shower <strong>and</strong> toilet rooms;<br />

g. In permitting, but not requiring, spouses or o<strong>the</strong>r consenting adults to share a room where<br />

both are residents <strong>and</strong> space is available;<br />

h. In taking all reasonable steps to comply with a resident's expressed wish <strong>for</strong> privacy in<br />

particular activities of daily living;<br />

i. In permitting representatives of protection <strong>and</strong> advocacy groups <strong>and</strong> community legal<br />

services programs to have full <strong>and</strong> free access to <strong>the</strong> facility during normal business<br />

hours.<br />

312.18 Each resident admitted to <strong>the</strong> facility may manage <strong>the</strong>ir personal financial affairs, or, if <strong>the</strong><br />

resident requests, such affairs may be managed by <strong>the</strong> facility. If <strong>the</strong> facility manages residents'<br />

funds, <strong>the</strong>n an accounting shall be maintained in accordance with Section 311.2 of <strong>the</strong>se<br />

<strong>regulations</strong>.<br />

312.18.1 In addition to any o<strong>the</strong>r requirements, <strong>the</strong> facility's management of resident financial<br />

affairs shall meet <strong>the</strong> <strong>following</strong> conditions:<br />

a. Should <strong>the</strong> facility manage <strong>the</strong> resident's personal financial affairs, written authorization<br />

must be made <strong>and</strong> signed as provided in Section 312.1(d) of <strong>the</strong>se <strong>regulations</strong>.<br />

b. <strong>The</strong> financial record must be available to <strong>the</strong> resident <strong>and</strong> his/her guardian, <strong>and</strong><br />

responsible party;<br />

c. If <strong>the</strong> facility makes financial transactions on behalf of a resident, <strong>the</strong> resident, guardian<br />

or responsible party shall receive an itemized accounting of disbursements <strong>and</strong> current<br />

balances at least quarterly;<br />

d. A copy of <strong>the</strong> resident's quarterly statements shall be maintained in <strong>the</strong> facility;<br />

e. <strong>The</strong> facility shall establish <strong>and</strong> maintain a system that assures full <strong>and</strong> complete<br />

accounting of resident personal funds using generally accepted accounting principles;<br />

f. <strong>The</strong> facility shall not commingle resident funds with any o<strong>the</strong>r funds;<br />
