Gov. Shapp Is Commended
In Inquirer's Editorial
PHILADELPHIA—The action of Gov.
Milton J. Shapp in vetoing the amtipornography
bill "took courage," said the Philadelphia
Inquirer, morning newspaper, in
commending the governor editorially.
"Afier all," said the editorial, "this is an
election year. Why make waves? Why
offend anyone? Let the courts strike down
the unnatural act, as they most assuredly
would. Shapp chose, instead, to veto the
bill, forthrightly and courageously, and we
congratulate him for doing so."
The newspaper called upon the state
legislature to follow the governor's recommendation
in his veto message to enact
legislation specifically tailored for such purpose
if it wants to control the display of
explicit sexual material. The editorial
pointed our 4hat the bill would have permitted
allegedly obscene material to be
seized without a hearing and destroyed in
one county when it would be perfectly acceptable
in another—creating "67 forms
of liberty or censorship, one for every county
in Pennsylvania."
"To uphold our constitutional rights and
liberries—freedom of speech and of the
press, due process of law and trial by jury
is not to favor hard-core pornography, the
weakening of family life or the moral
destruction of children," the Inquirer stated.
"Whatever the legislature does, however.
it has no business infringing upon ihe
rights free citizens to see and re^id whai
of
thcv
wish."
Newspaper Says Proposed
Law Was a 'Monstrosity'
PirrSBURGH — The censorship-aniipornography
bill vetoed by Gov. Milton
Shapp. who seeks re-election, had allowed
the absurd situation of grand juries in each
of the commonwealth's 67 counties setting
up iheir own standards for obscenity. Also,
the bill popularly passed by the gener.il
assembly included numerous provisions ol
dubious constitutionality and five that the
state attorney general found "certainly unconstitutional."
The governor states that he supports
legislation to ban obscene advertising and
the display of sexually explicity material
where children might come in contact with
it. A Post-Gazette editorial reported: "This
is a sensible and needed approach to the
only pornography problem that the law
has any business addressing and we join
with the governor in seeking laws that will
protect children from sexually explicit materials
without infringing on the right ol
adults to see and read what they choose.
The editorial termed the bill a "monstrosity."
In Harrisburg. a number of legislators
desire to introduce new antismut bills to
add to the many already on file and buried
in various committees in the 159th regular
session of the general assembly, held over
from the 158th session of 197.3.
Representatives Fred C. Noye. Peter E.
Perry and Stanford I. Lehr got their heads
together and introduced a proposed act prohibiting
X-rated movies "to be shown only
in outdoor theatres and providing penalties."
This is HB-1939 and has just been handed
to the House's law and justice committee.
A year ago, another bill, HB-748, required
X-rated movies to be shown only in indoor
theatres, etc., and there has been no action
on that proposal by the same law and justice
committee since April 9, 1973.
