ANNEX B: AGENDA Regional Consultation on <strong>the</strong> “Women’s Right to Adequate Housing and Land” in cooperation with UN Special Rapporteur on Right to Adequate Housing Fiji, 12 to 15 October 2004 Working Agenda: Part I : Preconsultation Workshop, 12-13 October 2004 Part II : The Consultation, 14-15 October 2004 Preconsultation Workshop The training curriculum follows a logical track that applies <strong>the</strong> four basic messages <strong>of</strong> <strong>the</strong> human rights as: 1. a common heritage <strong>of</strong> humankind (based on human needs) 2. a common language among peoples and states (<strong>the</strong> law) 3. (remedial) means to defend ourselves and o<strong>the</strong>r from harm, and 4. (preventive) tools to build a better community, society and world. The first two <strong>of</strong> <strong>the</strong>se four are <strong>the</strong> <strong>the</strong>oretical part <strong>of</strong> human rights, and <strong>the</strong> latter two are <strong>the</strong> applied aspects <strong>of</strong> human rights. As in any complex task, <strong>the</strong> <strong>the</strong>oretical basis is required in order effective to execute it. So is <strong>the</strong> case here also, even though many <strong>of</strong> <strong>the</strong> participants may have a human rights grounding, it must be understood that we are building toge<strong>the</strong>r a common framework that allows us to use all available tools, including and especially <strong>the</strong> law, and order <strong>the</strong>ir use in a strategic manner. DAY ONE, 12 October 2004 08:30–09:00 Registration Session I : Introduction to <strong>the</strong> Legal Concepts and Framework <strong>of</strong> <strong>the</strong> Human Right to Adequate Housing This introductory session will allow <strong>the</strong> participants to get to know each o<strong>the</strong>r within <strong>the</strong> context <strong>of</strong> <strong>the</strong> right to housing. It will also follow <strong>the</strong> logical process <strong>of</strong> introducing <strong>the</strong> right from <strong>the</strong> popular concept <strong>of</strong> human needs as <strong>the</strong> common language <strong>of</strong> human rights, before we get into <strong>the</strong> legal sources. Rights have been claimed long before <strong>the</strong>ir codification in law, as we will demonstrate also by <strong>the</strong> order <strong>of</strong> <strong>the</strong> curriculum. The participants each will symbolise graphically what <strong>the</strong> women’s human right to adequate housing means to <strong>the</strong>m. They will have colored pens and a single sheet <strong>of</strong> paper to depict EXECUTIVE SUMMARY 65
<strong>the</strong> meaning in no more than three symbols. In o<strong>the</strong>r courses, this has revealed some very interesting and creative results, including depiction <strong>of</strong> all <strong>the</strong> elements <strong>of</strong> <strong>the</strong> right to adequate housing that are now enshrined in international law and jurisprudence. We will post all <strong>of</strong> <strong>the</strong> artwork on a wall or bulletin board in <strong>the</strong> training room for <strong>the</strong> duration! <strong>of</strong> <strong>the</strong> course. 09:00–09:20 Overview <strong>of</strong> program, materials, goals and objectives (Joseph Schechla) 09:20–09:30 Presentation <strong>of</strong> self-introduction exercise 09:30–09:45 Participants prepare <strong>the</strong>ir concepts <strong>of</strong> “adequate housing” 09:45–10:30 Participants introduce <strong>the</strong>mselves and <strong>the</strong>ir concepts 10:30–10:45 Tea break 10:45–11:30 From human needs to human rights: <strong>the</strong> legal sources <strong>of</strong> <strong>the</strong> human right to adequate housing (Miloon Kothari) This first substantive session will link <strong>the</strong> popular concepts to <strong>the</strong> legal right as it has been developed in human rights treaty law and fur<strong>the</strong>r developed in <strong>the</strong> General Comments and jurisprudence <strong>of</strong> <strong>the</strong> treaty-monitoring bodies. The time will not require—nor allow for—spending a lot <strong>of</strong> time on <strong>the</strong> details <strong>of</strong> each <strong>of</strong> <strong>the</strong> elements in GC 4, but simply presenting <strong>the</strong>m and <strong>the</strong> prohibitions against forced eviction as <strong>the</strong> legal guidance for implementing state obligations: introduce questionnaire. It will also require identifying <strong>the</strong> “congruent” human rights that also relate directly or indirectly to <strong>the</strong> HRAH (right to property [in UDHR], information, participation, etc.). It will end with <strong>the</strong> over-riding principles <strong>of</strong> selfdetermination, nondiscrimination, rule <strong>of</strong> law, gender equality and non-regressivity, as <strong>the</strong>y apply to all rights (especially ESCR). There will be a brief overview <strong>of</strong> <strong>the</strong> linkages between VAW and RAH and an introduction to <strong>the</strong> SRAH’s questionnaire. 11:30–13:00 How and what to monitor The elements <strong>of</strong> <strong>the</strong> human right to adequate housing as a monitoring framework (Joseph Schechla) The session will begin with a set <strong>of</strong> logical steps for making <strong>the</strong> women’s HRAH case, similar to all human rights advocacy. It will present <strong>the</strong> moral, legal and factual aspects <strong>of</strong> argumentation, but focus on <strong>the</strong> legal authority. Here, we will take each <strong>of</strong> <strong>the</strong> GC 4 elements <strong>of</strong> <strong>the</strong> right to housing and <strong>the</strong> congruent rights and explore <strong>the</strong>m with both <strong>the</strong>ir popular and <strong>the</strong>ir legal bases. This will follow <strong>the</strong> methodology <strong>of</strong> <strong>the</strong> HLRN “Tool Kit” and <strong>the</strong> materials provided in <strong>the</strong> participants’ packet. 13:00–14:00 Lunch 14.00–15.00 The “Tool Kit” (Joseph Schechla) Following <strong>the</strong> completion <strong>of</strong> <strong>the</strong> HRAH elements presentation, <strong>the</strong> final session <strong>of</strong> <strong>the</strong> day will reveal all <strong>of</strong> <strong>the</strong> logical monitoring steps in <strong>the</strong> “Tool Kit” methodology. It will introduce <strong>the</strong> categories and sample questions to answer when presenting a case. It will emphasise <strong>the</strong> factual/statistical aspects <strong>of</strong> pr<strong>of</strong>essional human rights monitoring with a presentation <strong>of</strong> <strong>the</strong> “Loss Matrix” for determining <strong>the</strong> costs arising from a violation. As per Di’s suggestions please note that this presentation <strong>of</strong> <strong>the</strong> Tool Kit, should already incorporate a gendered approach to <strong>the</strong> right to adequate housing, incorporating <strong>the</strong> amendments identified at <strong>the</strong> Delhi and subsequent consultations. 66 WOMEN’S RIGHTS TO ADEQUATE HOUSEING AND LAND
