THE RECOMMENDATIONS OF THE<br />

DISAPPEARANCES COMMISSIONS<br />

This Part examines and tabulates the recommendations by the three<br />

zonal Commissions <strong>of</strong> Inquiry into Disappearances (1994) and the<br />

1998 All Island Commission on Disappearances.<br />

It also provides a pointer to the current state <strong>of</strong> the law as compared<br />

against the recommendations and refers to emergency law for that<br />

purpose.<br />

The emergency law regime referred to in this Part comprises the<br />

Emergency (Miscellaneous Provisions and Powers) Regulation No 1<br />

<strong>of</strong> 2005 as contained in Gazette No 1405/14, as amended particularly<br />

on August 5th 2008 by Gazette No 1561/11 and on May 2nd 2010<br />

by Gazette No 1651/24 as well as the Emergency (Prevention and<br />

Prohibition <strong>of</strong> Terrorism and Specified Terrorist Activities) Regulation<br />

No 7 <strong>of</strong> 2006 as contained in Gazette No 1474/5 <strong>of</strong> 6 December 2006<br />

(as amended).<br />

These Regulations have been promulgated under the Public Security<br />

Ordinance, (PSO) No 24 <strong>of</strong> 1947 (as amended). The Prevention <strong>of</strong><br />

Terrorism Ordinance (PTA), Act No 48 <strong>of</strong> 1979 (as amended) will<br />

also be referred to.<br />
