3000.50 In the event the filing <strong>of</strong> cases pursuant to paragraphs 3000.10 and 3000.4 <strong>of</strong>this rule shall result in a disparity <strong>of</strong> civil filings reflected by the Quarterly Case Status Report(QCSR), the judges <strong>of</strong> the Superior Division may jointly direct the Clerk <strong>of</strong> the Court to assigncase filings so as to eliminate the disparity.3000.60 Case Type Categories MH, AD, PO, or MI. When a party wishes to file anew action <strong>of</strong> the case type categories MH, AD PO, or MI: (non-domestic relations matters), theymay file it with any judge <strong>of</strong> the Court who is available. Petitions for the Issuance <strong>of</strong> a HardshipLicense must be filed in the Court that ordered the driver’s license suspension entered if that Courtis located in Porter County. A petition for relief filed pursuant to IC 35-38-9 must be filed in theCourt that entered the conviction or conviction being addressed. (Amended effective August 9,2013).3000.70 Any domestic relations related matter that is required to be filed with the MIcase designation is governed by <strong>Local</strong> <strong>Rule</strong> 3000.40.3000.80 Venue Cases and Filings by Mail. For cases venued into Porter Countyand cases filed by mail, the Clerk shall act on behalf <strong>of</strong> the parties for purposes <strong>of</strong> case assignmentprocedure.3000.90 Judicial Action before Filing. If a case being filed requires some action bya judge before filing, e.g., waiver <strong>of</strong> filing fees, the party filing the action must go to the Clerk'sOffice to determine case assignment before taking the case to the Judge. In such cases, no causenumber will be assigned until the parties return to the Clerk after action by the Judge.3000.100 Selection <strong>of</strong> Special Judges under Trial <strong>Rule</strong> 79(H). In case typecategories CT, MH, AD, PO, MI, PL, CC, and MF, and any other civil case type designations asmay hereafter be required to be reported on the Quarterly Case Status Report (QCSR), if the causenumber <strong>of</strong> the case in which a special judge needs to be appointed under this section begins with64D01, the judge <strong>of</strong> Porter Superior Court #3 shall be appointed special judge. If the causenumber <strong>of</strong> the case begins with 64D02, the judge <strong>of</strong> Porter Superior Court #4 will be appointedspecial judge. If the cause number begins with 64D03, the judge <strong>of</strong> Porter Superior Court #1 willbe appointed. If the cause number begins with 64D04, the judge <strong>of</strong> Porter Superior Court #2 willbe appointed. If the cause number begins with 64D05 or 64C01, the judge <strong>of</strong> Porter SuperiorCourt #6 will be appointed. If the cause number begins with 64D06, the judge <strong>of</strong> Porter CircuitCourt, sitting as Superior Court #5 will be appointed.3000.110 In case type categories DR, RS, ES, EU, GU and TR, and any otherdomestic relations or estate related civil case designations as may hereafter be required to bereported on the Quarterly Case Status Report (QCSR), if the cause number <strong>of</strong> the case in which aspecial judge needs to be appointed begins with 64D01, 64D03, 64D05 or 64C01, Porter CountyMagistrate #2 shall be appointed as special judge. If the cause number <strong>of</strong> the case begins with64D02, 64D04 or 64D06, then Porter County Magistrate #1 shall be appointed as special judge.29
LR64-TR03-3100WITHDRAWAL OF APPEARANCE3100.10 Procedure. All withdrawals <strong>of</strong> appearances shall be in writing and by leave<strong>of</strong> Court. Permission to withdraw shall be given only after the withdrawing attorney has given theattorney's client ten (10) days written notice <strong>of</strong> the attorney's intention to withdraw and has filed acopy <strong>of</strong> such with the Court. The Court will not grant a request for withdrawal <strong>of</strong> appearanceunless the same has been filed with the Court not less than 30 days prior to any scheduledhearing, except for good cause shown as determined by the Court.(1) A withdrawal <strong>of</strong> appearance when accompanied by the appearance <strong>of</strong> other counselshall constitute a waiver <strong>of</strong> the requirements <strong>of</strong> this <strong>Rule</strong>.(2) All withdrawals <strong>of</strong> appearance shall comply fully with the provisions <strong>of</strong> <strong>Rule</strong>s <strong>of</strong>Pr<strong>of</strong>essional Conduct, <strong>Rule</strong> 1.16.3100.20 Contents <strong>of</strong> Notice. The letter <strong>of</strong> withdrawal shall explain to the client thatfailure to secure new counsel may result in dismissal <strong>of</strong> the client's case or a default judgment maybe entered against the client, whichever is appropriate, and other pertinent information such as anyscheduled hearing date or trial date.LR64-TR03-3200 PREPARATION OF FILINGS3200.10 As used in these rules, the word “filing” shall mean and include pleadings,motions, and any other papers filed with the Court by any party to any cause. All filings shall beprepared in accordance with the provisions <strong>of</strong> the <strong>Indiana</strong> <strong>Rule</strong>s <strong>of</strong> Trial Procedure. For thepurpose <strong>of</strong> uniformity and convenience, the following requirements shall also be observed.3200.20 Production and Form. Filings may be either printed or typewritten onwhite, 8-1/2" x 11" paper, with lines double spaced except for quotations, which shall be indentedand single spaced and printed on one side only. Copies <strong>of</strong> filings shall likewise be printed onwhite paper. Legal-size paper is not permitted. Legible handwritten filings may be accepted inthe discretion <strong>of</strong> the Court.3200.30 Caption. Every filing shall contain a caption setting forth the name <strong>of</strong> theCourt, the title <strong>of</strong> the action and the file or cause number. A space two inches (2") square shall beleft open for purposes <strong>of</strong> file marking each filing.3200.40 Title. Titles on all filings shall delineate each topic included in the filing,e.g. where a filing contains an Answer, a Motion to Strike or Dismiss, and a Jury Request eachshall be set forth in the title.30
