Legislative Requirements and Corporate PolicyContext that governs the Home and Community CareProgram• The Aged Care Act (1997) which governs all aspects of the provisionof residential care, flexible care and Community Aged Care Packages(CACP’s) to older Australians.• The Community Care Common Standards 2011• South Australian Home and Community Care (HACC) ServicePrinciples• The Privacy Act 2001 which applies to personal information.• The Freedom of Information Act 1991 which provides for publicaccess to official documents and records; to provide for the correctionof public documents and records in appropriate cases; and for otherpurposes.• The SA State Records Act 1997 which provides for the disposal ofofficial records.• The Disability Services Act 1993 which provides for the funding andthe provision of disability services.• The SA Carers Act 2005 and the SA Carers Charter Principles whichprovide for the recognition of carers.ReferralsReferrals to the Home and Community Care Program can be made byindividuals needing assistance, their families, friends, doctors and otheradvocates. When a person other than the service user is making a referralto the program, the consent of the potential service user must be verified bythe City of Burnside Home and Community Care Program staff before thereferral is accepted. When consent has not been given, the program staffshall advise the referring person that the referral cannot be accepted untilconsent is obtained.6
