Pensions fixed at monthly rates are payable monthly on and after the first dayof the following month;Provided that when there is a variation in the rate of a pension consequent onthe disbursment of the commuted value of a portion thereof, pension for the brokenpart of the month at the original rate may be paid before the end of month.360. If the first day(including Sunday) of the following month is a Public Holiday onwhich Pensions are not disbursed at the treasury , the Collector may, if he thinks fit,direct the Payment of Pension to be made on the last working day of the month towhich the pension relates except in the case Pension for the month of March whichshall be paid on or after the first working day of the succeeding month.PAYMENT OF CLAIMS361. Save as hereinafter provided, a pensioner must be take payment in personafter identification by comparison with the Pension Payment Order.Pension up to Rs. 300 per month may, as far as practicable, be disbursed incash at the treasury at the request of the pensioners.362. A pensioner of any description, who produces a life certificate signed by someperson exercising the powers of a Magistrate under the Criminal Procedure Code, orby any Register or Sub-Registrar appointed under the Indian Registration Act, 1908,or by pensioned officer who, before retirement exercised the powers of a Magistrate,or by any gazetted officer, or by a retired gazetted officer in respect of thesepensioners only who draw pension from the same treasury from which he himselfdraws his own pension, or by a police officer not below the rank of Sub-Inspector incharge of a Police Station or by a Post master, a Department Sub-Postmaster, or anInspector of Post Officers, or by a Class I Officer of the Reserve Bank of India or anOfficer of the State Bank of India or a Sub-Accountant appointed as an Agent or asan Accountant at a branch of the State Bank of India, or an Officer of a subsidiarybank of the State Bank of India, or by a Member of the Madhya Pradesh LegislativeAssembly or by the Sarpanch of Gran Panchayat or by a bank included in the SecondSchedule to the Reserve Bank of India Act 1934, in respect of a pensioner drawinghis pension through that bank is exempted from Personal appearance.A pensioner not resident in India in respect of whom his duly authorisedagents produces a life certificate signed by a Magistrate, a Notary, a Banker or adiplomatic Representative of India is exempted from personal appearance.364. Payment of pensions to police pensioners may be made in accordance with therules in this section, but if the disbursing officer entertains any doubt as to theidentity of such a pensioner, he may require the local Inspector of Police to identifyhim. The Inspector would then be responsible for the correct identification of thepensioner.365. A pensioner not resident in India may with the permission of Reserve Bank ofIndia draw his pension in India through a duly authorised agent, processing a legallyvalid power of attorney, who must produce a life certificate on each occasion, unlessCHAPTER IV 2 of 60WITHDRAWAL FROM <strong>THE</strong> CONSOLIDATED FUNDAND <strong>THE</strong> PUBLIC ACCOUNT


<strong>THE</strong> <strong>MADHYA</strong> <strong>PRADESH</strong> <strong>TREASURY</strong> <strong>CODE</strong>VOLUME Ithe duly authorised agent ha executed an indemnity bond to refund overpayment inwhich case he has to produce the life certificate at least once a year.366. A pensioner of any description resident in India is exempted from personalappearance if he draws his pension through an agent who has executed a bond torefund overpayments and procedure at least once a year a life certificate signed by aperson authorising under Rule 363 to sign such certificate.The life certificates so collected should be forwarded to the AccountantGeneral every year in April.367. The pension of a person drawing his pension through an authorised agent whohas executed a bond to refund overpayments, shall not be paid on account of aperiod of more than a year the date of the life certificate last received, and thedisbursing officer shall be on the watch for authentic information of the decease ofany such pensioner, and on receipt thereof, shall promptly stop further payments.Note:- A list of agents approved by the State Government who have executed thenecessary bond of indemnity is given in Annexure to Subsidiary Rule 238.368. When a pensioner is a minor, or is for any other reason incapable of managinghis own affairs, and has no regularly appointed manager or guardian, the Collectorsmay, on application by, or behalf of the pensioner, and subject to such conditions ashe may impose, declare any suitable person to be the manager or guardian for thepurpose of receiving, on behalf of the pensioner, the pension due to him, andpayments of pension may be made to such manager or guardian in the same way asto the original holder, provided that sufficient proofs are forthcoming at the time ofeach payment of the original holder being alive and eligible to receive the pension forthe period covered by the payment. Such declaration may, at any time, be revokedor altered at the description of the Collector.FORMS OF PENSION BILLS AND CONNECTED CERTIFICATES.369(1) Save as hereinafter provided in this rule, claims for payment of pensions shallbe presented on bills in a form similar to Form M. <strong>THE</strong> <strong>MADHYA</strong> <strong>PRADESH</strong> <strong>TREASURY</strong> <strong>CODE</strong>VOLUME Isupplied by the disbursing officer to each pensioner or his agent or representative.The bill must be duly receipted by the pensioner or by some other person authorizedto give legal acquittance on his behalf, and if the pensioner cannot sign his name, histhumb -impression the thumb or the great toe impression being duly attested by awell-known and respectable person shall be taken on the bill.Save as provided in Subsidiary Rule 376 (a) the Pensioner's portion of thePension Payment Order must invariably be presented with the bill.In the case physically handicapped pensioners who are unable to sign or puttheir thumb/great toe imp ression and purdahnashin ladies, quittance by seal markattested by some well-known and respectable person may be accepted in lieu ofsignature or thumb/great toe impressions.Note:- The anticipatory pension of non-gazetted Government servants shall bedrawn on a separate establishment pay bill in Form M. P. T. C. 24.(2) Instead of requiring each individual pensioner to present a separate bill inForm M. P. T. C. 40 , the disbursing officer may, subject to such general or specialinstructions as the Accountant-General may issue in this behalf, prepare a single billin Form M. P. T. C. 41 for on account of each class of pensions. On this plan thereceipt of each pensioner appearing personally shall be taken in the column providedfor the purpose, while separate receipts shall be appended to the bill in support ofpayments, if any, made at the sub-treasury, or on life certificates, note being madein the latter case on the separate receipt of the names of the persons actuallyreceiving the money. On all such documents shall be entered the number of theentry in the bill.370. In cases(other than those specified in Rules 365 and 366) where the pensionerdesires to draw pension through an agent or a representative nominated by him, alife certificate must accompany every pension claim for the months of June andDecember. The life certificates shall be signed by a person authorised under theserules to sign such certificates and must be dated not earlier than the last day of themonth concerned.CHAPTER IV 4 of 60WITHDRAWAL FROM <strong>THE</strong> CONSOLIDATED FUNDAND <strong>THE</strong> PUBLIC ACCOUNT

When a pensioner draws his pension through an agent or representative, theclaim must be supported by the written authority of the pensioner to pay the pensionto the agent or the representative nominated by him to receive payment on hisbehalf. In such cases, the endorsement "Received payment" must be signed by thepensioner and a separate receipt which need not be stamped shall be endorsed bythe agent or the nominee, as the case may be, in token of having actually receivedthe payment.372. Where the determination of pension cannot be fixed for a precise date, andsubject to provisions of S. R. 373, the pensioner's bill must be accompanied by acertificate in Form M. P. T. C. 42 duly signed by a person authorised to sign lifecertificate under S. R. 363.373. (1) A declaration in the following form shall be obtained half yearly (in May andNovember) from all recipient of family pension except widows whose pension isterminable on their re-marriage;HALF YEARLY DECLARATION OF PENSIONERS WHOSE PENSIONS ARETERMINABLE ON <strong>THE</strong>IR MARRIAGE OR REMARRIAGE. <strong>THE</strong> <strong>MADHYA</strong> <strong>PRADESH</strong> <strong>TREASURY</strong> <strong>CODE</strong>VOLUME IDesignation. . . . . . . . . . . . . . . . . . . . . . . .(3) Every pension-disbursing officer shall submit to the Accountant-General,Madhya Pradesh, a statement showing particulars and date of last payment ofpensions in respect of the cases to furnish the above declaration(except thatfurnished by the widow recipient of family pension) in the months of June &December.373-A(1) Retired class I officers are required to furnish half yearly a declaration inMay and November each year in the prescribed form about acceptance/nonacceptanceof any commercial employment within two years from the date of theirretirement.(2) Retired Government servants, other than Class IV servants, are requiredto furnish half yearly a declaration in May & November each year in the prescribedform about acceptance/non-acceptance of employment under any Government outside India.(3) In cases where employment mentioned in (1) and (2) above has beenaccepted without obtaining Government's approval, the pension-disbursing officerwill seek Government's orders before making further pension payments.374-A. A Treasury Officer will in case of death of a pensioner governed by theFamily Pension Scheme for the State Government Employees, 1966, start payingfamily pension to the widow/widower on receipt of death certificate of the pensionerand the Application in Form M. P. T. C. 42-A for the grant of family pension toher/him, and he will also send as intimation in this regard to the Accountant-Generalin Form M. P. T. C. 42-B.RATE OF EXCHANGE FOR CONVERSION OF PENSIONS FIXED IN ANO<strong>THE</strong>RCURRENCY.CHAPTER IV 7 of 60WITHDRAWAL FROM <strong>THE</strong> CONSOLIDATED FUNDAND <strong>THE</strong> PUBLIC ACCOUNT


<strong>THE</strong> <strong>MADHYA</strong> <strong>PRADESH</strong> <strong>TREASURY</strong> <strong>CODE</strong>VOLUME Ibefore any payment is ordered, and if he feels any suspicion, shall refer it to thepensioner before payment.Note:- In so far as Disbursing Officer is concerned, the authority of a person toreceive payment of pension on behalf of a pensioner, shall be deemed toremain unimpaired until its termination by the death of the pensioner, orotherwise, becomes known to the Disbrusing Officer.RECORD OF PAYMENT378. Every payment must be entered on the reverse of both portions of the Pensionpayment Order and attested by the signature of the disbursing officer. In the case ofpensions paid at a sub-treasury to which only a copy of the Order is supplied underrule 355, the Sub-treasury Officer shall make the entry on the Pensioner's portion ofthe Order and on his copy, while the Treasury Officer at the headquarters treasuryshall, from the concerned voucher, make the necessary note on his original of theOrder.PAYMENT OF PENSIONS BY POSTAL MONEY ORDER379. The payment of pensions may be made by postal money orders at the optionof the pensioner. When this mode of payment is adopted the following rules shall beobserved:--(1) A Pensioner who elects to have his pension paid by money ordershould present in person to the Treasury Officer a declaration to thateffect with his copy of the Pension Payment Order. The TreasuryOfficer should then identify the pensioner as laid down in SubsidiaryRule 376, and make him understand that his pension will be remittedby money order provided his non-employment certificate reaches thetreasury before the 10th of each month. After this has been done heshould paste the declaration and both copies of the Pension PaymentOrder in a separate file register headed "Pensions Payable by moneyOrder". On a date not later than the 10th of each month, the TreasuryOfficer should arrange to make out a money order form for eachCHAPTER IV 9 of 60WITHDRAWAL FROM <strong>THE</strong> CONSOLIDATED FUNDAND <strong>THE</strong> PUBLIC ACCOUNT


<strong>THE</strong> <strong>MADHYA</strong> <strong>PRADESH</strong> <strong>TREASURY</strong> <strong>CODE</strong>VOLUME Ipension recorded in the file mentioned above less money ordercommission and make corresponding payment entries in the table atthe backe of the Pension Payment Order. Such money orders shouldbe addressed to those pensioners only from whom the nonemploymentcertificates and no marriage certificates, when necessaryhave been received in the treasury before the 10th of a month. TheTreasury Officer should sign the money order form and initial theentries on the back of the Pension Payment Orders after comparing thethree documents carefully.(2) In order to minimise the risk of fraud, the Treasury Officer shouldcompare the signature on the money receipt every month with thepensioner's signature on the Disburser's portion of the PensionPayment Order. The Treasury Officer should also satisfy himself once ayear, in such manner as he thinks desirable that the pensioner isactually alive. In token of having done so, he must endorse on theschedules of payments for the month of April each year a certificate tothe effect that he has satisfied himself that the pensioners wereactually alive on the dates on which the pensions were remitted tothem.(3) In case of a female pensioner whose pension is terminable onmarriage or remarriage, a declaration in the form prescribed in S. R.373, shall be obtained by the Treasury Officer before remitting thepensions for the month of June and December. In other cases, wheredetermination of Pension cannot be fixed for a precise date theTreasury Officer should, before remitting the pension for the months ofJune and December, obtain from the pensioner a certificate in form M.P. T. C. 42.(4) The Collector should arrange with some village official or other suitablesubordinate agency, such as the police, for reporting promptly to theTreasury Officer the death of a pensioner whose pension is paid bymoney order.CHAPTER IV 10 of 60WITHDRAWAL FROM <strong>THE</strong> CONSOLIDATED FUNDAND <strong>THE</strong> PUBLIC ACCOUNT

The payme nt should be shown in a separate schedule,which will serve as voucher. A certificate in the following form in thehandwriting of the Treasury Officer should be endorsed on theschedule:--"Certified that I have satisfied myself that all payments noted in the schedulehave actually been remitted by money order".Note:-1- In the schedules for January and July each year, an additional certificate onthe following form should be added:-"Certified (1) that I have obtained from each pensioner a declaration that hehas not received any remuneration for serving in any capacity under Government orunder a Local Fund during the past six months, and (2) that in all cases wheredetermination of a pension cannot be fixed for a precise date, I have obtained thecertificates in Form M. P. T. C. 42 or the declarations in the form prescribed in S. R.373, as the case may be. "Note: 2- The words or the declaration in the form prescribed in S. R. 373 as thecase may be' appearing in the certificate No. (2) will be added in thecertificate attached to the schedule for January only vide S. R. 373.(6) The amount to be remitted should not be paid to the post office incash but by transfer to the credit of the post office. The money orderforms should be sent to the post office with a certificate by theTreasury officer that the amounts of the money orders and the feesthereon have been credited to the post office in the treasury accountby transfer. (see subsidiary Rule 182).(7) In the schedule for the month following the month of payment theTreasury Officer will furnish the following certificate:"Certified that I have satisfied myself that all persons included in the schedulefor the previous month have been paid to the proper persons and that I haveCHAPTER IV 11 of 60WITHDRAWAL FROM <strong>THE</strong> CONSOLIDATED FUNDAND <strong>THE</strong> PUBLIC ACCOUNT

"(8) The Treasury Officer is only responsible to supply complete and correctinformation regarding such pensioners.(9) The Treasury Officer should arrange to get a sufficient supply of thepost-card size non-employment certificate forms from the ControllerStationery and Text Books M. P. Bhopal.(10) The Treasury Officer should give pensioners all the informationnecessary to enable them to take advantage of the concession andparticularly instruct them as to the manner in which form referred to inclause(9) above is to be used and the purpose which it is intended toserve.Note:- The procedure authorised in this rule may be applied mutains mutandis topensions payable at a sub-treasury or any other disbursing office.380(1) Where owing to old age or infirmity, or in consequence of some physicaldisability, it is not possible for a pensioner to present in person to the TreasuryOfficer, a declaration electing to have his pension paid by money order, the TreasuryOfficer may accept instead a written declaration signed by the pensioner and dulyverified under his seal by a gazetted officer, a magistrate, a tahsildar, a naibtahsildar,a Development Assistant, a police offic er not below the rank of Sub-Inspector in-charge of police station or any Government Officer or equivalent rankhaving his headquarters at the place where the pensioner is living for the time being.The Officer verifying the declaration shall specify the circumstances in which he holdsthat it is not possible for the pensioner, to present the declaration in person to theTreasury Officer. (Govt. of India's correction slip 624 to Central Treasury Rule361(1)).(2) Should the pensioner be physically incapable of signing the declaration,the Treasury Officer may authorise payment on production of a certificate from theCivil Surgeon of the district or a registered medical partitioner to the effect that theCHAPTER IV 12 of 60WITHDRAWAL FROM <strong>THE</strong> CONSOLIDATED FUNDAND <strong>THE</strong> PUBLIC ACCOUNT

In such case, thepension may be paid to the heir, not being a minor, who would receive payment ofthe arrears of pension in the event of the pensioner's death provided it is certified bythe Collector that the person claiming to be the heir is in fact the heir andcontinues to be the heir throughout the period for which he draws the pension.SPECIAL RULES APPLICABLE TO POLITICAL PENSION.381(1) The special rules regulating the payment of political pensions are contained inthe Annexure to this section(see also Subsidiary Rules 344 to 346 and 387).(2) A Treasury Officer has nothing to do with claims to succeed to, or toparticipate in, political pensions or allowances, but should direct applicants to applyto the Collector.(3) Descriptive Rolls of Political Pensions--when sanction is applied for to thepayment of a political pension, the Collector should prepare a descriptive roll of thepensioner in form appended to the Annexure to this section and forward it with theapplication.CONDITIONAL PENSIONS, ETC382. In some cases political pensions are granted on condition that certain requiredservices are duly performed, or as in the case of temple grants, that the shrine ortemple is maintained etc. In these a certificate is required from the Collector on thereceipt for the pensions that the condition (whatever it is) has been fulfilled.PAYMENT OF COMMUTATION MONEY383. (1) The payment of the commuted value of a portion of a pension can be madeupon the authority issued by the Accountant-General only to, and upon the receiptof, the person legally entitled to receive it, and not otherwise.(2) In every order authorising the payment of the commuted value of aportion of a pension, the Accountant-General will specify the date up to which thepension may be paid at the old unreduced rate. The pensioner's title to receive theCHAPTER IV 13 of 60WITHDRAWAL FROM <strong>THE</strong> CONSOLIDATED FUNDAND <strong>THE</strong> PUBLIC ACCOUNT

No payment of pension for asubsequent day should be made until a revised Pension Payment Order has beenreceived from the Accountant-General. If, however, in any ease, the commutedportion of the pension to which the pensioner was not entitled under this article hasbeen paid to him before the receipt of the Accountant-General's order authorising thepayment of the commuted value, the commuted portion so paid shall be deductedfrom the amount payable in commutation. A note will be made on the old PensionPayment Order of the amount deducted, before both halves of the Order arereturned to the Accountant-General to enable the latter to issue a revised PensionPayment Order.GRATUITIES384. Gratuities including Death-cum-Retirement Gratuities shall not be paid excepton an authority received from the Accountant-General to whom the sanction iscommunicated by the sanctioning authority or by another Audit Officer. Payment canbe claimed on the letter of authority itself, and no separate bill is necessary andshall be made in the same manner as laid down in subsidiary rules 530 and 531 inrelation to Provident Funds.Note:-1 When at the option of the Gratuitant the gratuity is drawn by the head of anoffice for disbursement, he shall furnish to the Accountant-General, within amonth of the date of drawal, a certificate of disbursement.Note: 2- The gratuity Pay Order and the payment Authority for commutation ofpension received from the Accountant-General, Madhya Pradesh must be keptin the personal custody of the Disbursing Officer so that an unauthorisedperson shall not have access thereto.Sub-section V-Periodical Identification of PensionersGENERAL RULES385. (1) On the first appearance of a pensioner on or after the first of April eachyear, the disbursing officer shall, except in the case of pensioner whose specimenCHAPTER IV 14 of 60WITHDRAWAL FROM <strong>THE</strong> CONSOLIDATED FUNDAND <strong>THE</strong> PUBLIC ACCOUNT

Thepensioner shall then be identified from the particulars given in the Disburser'sportion of the Pension Payment Order or in the Audit Register as the case may be.Identification shall also be made by an examination of the impressions given on thebill with those attached to the Pension Payment Order, or kept in the Audit Register,or reference to the pensioners' photograph where one is passed on the Disburser'sportion of the Pension Payment Order, if he cannot be identified by other means withabsolute certainty.(2) Except persons who have been gazetted Government servants, andpersons who have been specially exempted by the Government on the ground thatthere can be no difficulty in future identification, all pensioners shall be liable to theoperation of this rule.(3) Purdahnashin ladies and illiterate pensioners give a thumb impression ontheir bills in the presence of the person who grants the life certificate, in case ofilliterate pensioners who personally attend the paying officer, before the disbursingofficer.386. In all cases referred to in Subsidiary Rules 362, 363 and 368, the disbursingofficer must take special precautions to prevent impositions and must, at least oncea year, receive proof independent of that furnished by the life certificate of thecontinued existence of the pensioner. For this purpose, the disbursing officer shall,save in cases of exemptions from personal appearance allowed by orders ofcompetent authority, require the personal attendance and due identification of allmale pensioners who are not incapacitated by bodily illness or infirmity from soattending and in all cases where such inability may be alleged, he shall require proofthereof in addition to the proof submitted of the pensioner's existence. (1) Unless the Government by general or special orders direct otherwise, apension remaining underway for more than a year shall cease to be payable by thedisbursing officer. It may not bepaid in installments at different times.7) A share in a joint may not be separated, except with the sanction of theState Government, after regular application under section 5 of the pensions Act(XXIII) of 1871).8) When a political pensioner is a minor or is for any other reason incapableof managing his own affairs, and has no regularly appointed manager or guardian,the Collector may, on application by the pensioner or by any friend of the pensioner,declare any suitable person to be his guardian for the purpose of receiving on hisbehalf the pension due to him, and payments of pension shall be made to suchguardian in the same way as to the original holder. When a pension is transferred from one to another the Collector fromwhose district it is transferred shall send couple of the register entry, together withall correspondence, etc. , affecting the pension, to the Collector to whose district itis transferred.REGARDING CLAIMS RELATING TO PENSIONS15. When a claim is made under section 5 of the Act relating to any pensionor grant, the Collector, if after such examination and enquiry as he thinks proper,considers that the claims should be heard and adjudicated, shall fix a day for thehearing of it and shall given notice thereof to all actual holders of the pension.16. At the time appointed(or at any other time to which the enquiry may beadjourned), the Collector shall proceed to hear the claim and may call for andexamine such witnesses and documents as he may deem necessary.17. Thereafter, on receiving the copy of the decision and decree of the civilcourt, certified under is hand, the Collector shall report the case as prescribed in rule17.GENERAL20. Subject to such general or special rules or subsidiary instructions as may beissued by the Government for the guidance of Government servants who arerequired to make purchase of stores on Government account, the payments foracquisition of stores required for the public service, shall be regulated in accordancewith the provisions of this section; except in so far as they are supplemented orvaried by special departmental regulations.Local purchase of petty articles or consumable stores of office contingentgrants are not subject to the rules in this section.PURCHASES IN INDIA-PURCHASES THROUGH <strong>THE</strong> INDIAN STORESDEPARTMENT.394. (1) Without prejudice to the generality of the provisions contained in thisChapter with regard to withdrawal of money from the Consolidated Fund and thePublic Account of the State for disbursement of Government account, the procedurerelating to payments for stores purchased through the Indian Stores Departmentmay be regulated by special orders issued by the Government in this behalf.(2) Subject to the provisions of clause(1) above, payments will in the firstinstance be made by the Deputy Accountant-General, Industries and supplies, bymeans of cheques drawn on any treasury or the Bank and subsequently adjusted tothe debit of the State accounts.Provided that, when the amount payable is less than one rupee, the paymentwill be made by the indenting officer concerned in accordance with the procedureapplicable to contingent expenditure.CHAPTER IV 30 of 60WITHDRAWAL FROM <strong>THE</strong> CONSOLIDATED FUNDAND <strong>THE</strong> PUBLIC ACCOUNT

The particulars and theamounts of such bills should be noted in the memorandum of expenditure inhis contingent bill, which need not be supported by a copy of the bill as isrequired in the case of other work bills mentioned in Subsidiary Rule. 332.O<strong>THE</strong>R PURCHASE IN INDIA395. Subjects as hereinafter provided, the provisions of section V shall applygenerally to payments for stores purchased in India otherwise than through theDirector-General, Industries and Supplies, New Delhi.396. As a general rule, payment for supplies is not permissible unless the storeshave been received and surveyed. Payments prior to verification of quality andquantity of the materials may be permitted in exceptional cases only, provided thatadequate safeguards exist to secure the Government against all losses in the eventof the materials being found short or defective. In all such cases a bill based of thematerials being found short or defective. In all such cases a bill based on actualmeasurement must be obtained as soon as possible after payment has been madefor submission to the Accountant-General.397. If not provided otherwise by departmental regulations, bill presented insupport of payments for purchase of stores shall be accompanied by a certificate thatthe articles detailed in the vouchers have been actually received and entered in thestock register. A reference to the page number of the stock register in which suchsupplies or stores have been entered, should be given by the drawing officers on thebills of the supplies, invoices, etc. It should also be certified that their quantities arecorrect and their quality good and according to specifications, that the rates paid arenot in excess of accepted or market rates and that suitable notes of payment havebeen made in the indents and invoices concerned to prevent double payment. Theauthority, unless it is a general one, under which the purchase is made, shall also bequoted. Particular care must be taken to ensure that no double payment isauthorised in respect of the same claim.(2) (i) The Accountant-General, after audit of the firm's bill, will purchase asterling draft in favour of the supplier in the United Kingdom and remit it direct tothe supplier under intimation to the departmental officers concerned in India.(ii) The Accountant-General will bring the cost of the sterling draft finallyto account against the relevant appropriations in the Indian portion of the budget.(3) In the case of stores ordered direct from firms abroad on F. O. B. basissubject to inspection by the Director General, India Supply Mission, London, thepayment will, if the purchasing officers have so desired, be made directly by the HighCommissioner for India on receipt of supplier's bills duly verified and certified by theDirector General. Such payments will be passed on to the Accounts Officer concernedin India for adjustment through the Account current between England and India,supported by the Supplier's bills duly certified by the Director General.Note:- Special care should be exercised by the purchasing officer in differentiatingthe articles purchased through the agency of the Director General, IndiaSupply Mission, London from those merely delivered to or shipped through hisagency. Payments for direct purc hase made in a foreign country other than the UnitedKingdom and America may be made direct to the suppliers by the purchasingGovernment servants, the cash required for such payments being drawn under therules in section V of this Chapter.Payments in foreign countries are ordinarily made by Bank drafts which theAccountant-General will obtain from the State Bank of India at Gwalior/Bhopal on therequisition of the Government servant concerned. The cost of such draft is debited tothe contingent grant of the Government servant at whose request they are obtained.The rates of exchange charged by the Bank on such occasions are accepted as final.Note: 1- Requisitions to the Accountant-General for Bank drafts should beaccompanied by a detailed bill or by the duplicate copy of the invoice for thegoods purchased.Note: 2- Bank drafts will be sent direct by the Bank to the Government servantsrequisitioning for them through the Accountant-General. The Bank will advisethe requisitioning Government servant direct of the rupee equivalent of thesterling drafts purchased by them. A copy of the requisition for Bank draftsent by the Accountant-General to the Bank will be furnished to theGovernment servants concerned who should address the Bank direct in caseof non-receipt of Bank drafts within a reasonable time.Section VIII-Works ExpenditureGENERAL402. (1) Expenditure on petty construction and repairs executed by civil officers,when it does not exceed Rs. 2, 500 in amount is treated as contingent expenditure ofthe department incurring it, and is subject to the rules in section V of this Chapter.When the amount exceeds that sum and the work is still executed by civil officers,the expenditure is treated as "Works expenditure of the department vested with theadministrative control of the expenditure and shall be classified under the minorhead "Works " subordinate to the relevant departmental major head.(2) In the case of building incharge of the Public Works Department, all worksof construction and repairs should ordinarily be undertaken by the Public WorksDepartment and the expenditure met from its budget grant. When by mutualagreement or under orders of Government the execution of public works costingmore than Rs. 2, 500 in undertaken by another department on behalf of the PublicWorks Department, the expenditure on such works is debatable to the Public WorksDepartment. In such cases the officer of the civil department executing the works istreated as a Public Works Disburser and is placed in funds through the nearestExecutive Engineer, so that he may have early assistance in regard to the proceduretechnical to that department.Note: 1- This rule does not apply to the Forest Department.Note: 2- The limit of Rs. 2, 500 applies to each individual estimate whether it relatesto one building or group of buildings.Note: 3- Civil officers should not incur any expenditure out of the funds placed attheir disposal for "petty construction and repairs", on buildings born on thebooks of the Public Works Department, either residential or non-residentialexcept on account of petty repairs of fixtures and the replacement of brokenglass in doors and windows in non-residential buildings required in theintervals between periodical repair done by the Public Works Department.CHAPTER IV 35 of 60WITHDRAWAL FROM <strong>THE</strong> CONSOLIDATED FUNDAND <strong>THE</strong> PUBLIC ACCOUNT

The term administrative control" when applied to CivilWorks implies inter alia the assumption of full responsibility for construction, up-keepand maintenance of buildings and other works and the provision of funds for theexecution of these functions. This responsibility is not diminished if the execution ofthe work is entursted to a different agency. Thus works, the administration of whichis not transferred from the Public Works Department may be mutual arrangement beexecuted by any other civil department. , but the charges in connection with themshall nevertheless be classified as Public Works expenditure. On the other hand, acivil department, to which the administration of a building has been transferred mayinvoke the aid of the Public Works Department for technical advice or execution butthe charges relating thereto shall be debited to the department concerned. Thefunction of the civil department in the former case and that of the Public WorksDepartment in the latter is merely that of the contractor, and the administration andthe control of the expenditure rests with the Public Works Department in the formercase and with the administrative department concerned in the latter>The agency bywhich the work's is executed shall not thus be the deciding factor in determining thequestion of classification.MODE OF OBTAINING CASH404. Save where under the provisions of these rules a disbursing officer isauthorized to obtain funds by drawing cheques on the treasury or the Bank or onpresentation of a simple receipt, cash required for works expenditure may be drawnon contingent bills on accordance with the procedure prescribed in section V of thisChapter.CHAPTER IV 36 of 60WITHDRAWAL FROM <strong>THE</strong> CONSOLIDATED FUNDAND <strong>THE</strong> PUBLIC ACCOUNT

When contingent bills are drawn for works expenditure, details showing thename of the work, the number and date of the order sanctioning the work and theamount of the sanctioned estimate shall invariably be entered in the bill. A fulldescription of each item of the expenditure, together with details, where necessary,showing the rates and quantities shall be given, and sub-vouchers, together with theactual payees' receipt, shall be furnished under the rules in section V of this Chapter.When it is not possible to give details of the expenditure at the time of drawing thebill, they must be given subsequently in a bill in Form M. P. T. C. 36 headed "notpayable at the Treasury", to which the necessary sub-vouchers shall be attached.The transmission to the Accountant-General of the detailed bill and sub-vouchersshall never be delayed for more than a month.Note:-payments for labour should be supported by the certificate prescribed inSubsidiary Rule 287.PAYMENT BY CHEQUES406. (1)In cases in which a disbursing officer is authorized to draw cheques on thetreasury or the Bank, all payments in respect of works expenditure shall be made bycheques, as far as possible. In drawing such cheques, the disbursing officers shall beguided by the general rules laid down in section I of this Chapter.(2) Subject as provide in Subsidiary Rule 145 petty sums under ten rupeesshall not be paid by cheques and for the disbursement of these and other claimswhich have to be paid in cash, e. g. , wages of labourers and of the establishmentscharged directly to works, etc. , the disbursing officer may draw money from time totime from the treasury or the Bank by cheques to replenish his cash chest.Save as provided above, no cheque shall be drawn untill it is intended to bepaid away, and cheques drawn in favour of contractors and others shall be madeover to them by the disbursing officer direct, though occasional delivery of a chequethrough a subordinate may be permitted at the discretion and responsibility of thedisburser.CHAPTER IV 37 of 60WITHDRAWAL FROM <strong>THE</strong> CONSOLIDATED FUNDAND <strong>THE</strong> PUBLIC ACCOUNT

(See Subsidiary Rule 284).Note:2- Payments due to contractors may be made to their banks direct inaccordance with the provisions of the Note below Subsidiary Rule 171(e).PAYMENTS TO LABOURERS407. As a general rule, and subject to such exceptions as may be authorized bydepartmental, wages of labourers engaged departmentally shall be drawn on musterrolls showing the names of the labourers, number of days they have worked and theamount due to each. The daily attendance and absence of laboures and fines, if any,infixed on them must be so recorded as to prevent any tampering with orunauthorized additions to, the entries once made.Subject as provided above, the muster rolls may be kept in such form and inaccordance with such methods as have been prescribed by the Public WorksDepartment. It is the initial record of the labour employed each day on a work andmust be written up daily by the subordinate deputed for the purpose.408. The payment made on muster rolls must be made or witnessed by theGovernment servant of the highest standing available in the disbursing office, whoshould certify to the payments individually or by group. The amount paid on eachdate shall be noted in words as well as in figures at the foot of the muster roll.409. If any items remain unpaid, the details thereof must be recorded separately inthe muster roll in which they were originally drawn, before it is finally passed by theperson who made the payment. Unpaid item shall subsequently be carried forwardfrom muster roll to muster roll unit they are paid, the payments being recorded andcertified in the same way as current items.Notwithstanding anything contained in this rule, it will be optional withdisbursing officer to adopt any other alternative method of making payment ofunpaid wages, provided that a systematic record of items remaining unpaid isCHAPTER IV 38 of 60WITHDRAWAL FROM <strong>THE</strong> CONSOLIDATED FUNDAND <strong>THE</strong> PUBLIC ACCOUNT

Wages of member of the work-charged establishment should be drawn andpaid on Form M. P. T. C. 43: "pay Bill of Work-charged Establishment", which is acombined pay bill and acquittance roll form.411. The names and claims of the entire work-charged establishment concerned,including absentees, must be shown in details in each bill. The names shall begrouped by works on which the men are employed, and the drawing officer mustcertify that the men were on duty during the periods shown against their names,each man being employed on the work and on the duties for which his appointmentwas sanctioned. Sanctions to the entertainment of the establishment shall be quotedin each case.Note:1- Deductions on account of fines, income-tax, etc. , should be shown byspecial entries against the names concerned.Note:2- If the acknowledgement of the payee cannot conveniently be obtained onthe bill itself, it may be obtained separately and attached to the bill as a subvoucher.412. Wages remaining unpaid on a passed bill on the date fixed for closing theaccounts of the month may be paid subsequently when claimed, on a separate bill,reference to the bill in which the charge was originally included and to the particularitem thereof being quoted in each case. In making payment of arrears, suitable noteof payment must be kept against the original entries in the bill or other records as toguard against second payment.PAYMENT TO SUPPLIERS AND CONTRACTORS413. Claims for such payments shall beprepared as far as possible by the claimants themselves in authorized form of billsand vouchers and no placement other than an advance payment may be authorizedunless the correctness of the claim in respect of quantities and rates as well as thequality of the work done or supplies made have been accepted and all calculationscarefully checked by a responsible officer.Subject to such general or special instructions as may be issued by theGovernment after consultation with the Accountant-General, measurement booksmay be kept in such from and according to such methods as may be authorized bydepartmental regulations.PAYMENT FOR WORKS DONE THROUGH LOCAL BODIES.414. When the maintenance of any Government buildings or roads is entrusted to aLocal Body, the payment made to it on this account shall be treated in the same wayas a payment for work done by a contractor.If lump sum payments have been agreed upon, each payment must besupported by a certificate recorded by a responsible Government servant that thework has been done in accordance with the conditions agreed upon.ADVANCE TO CONTRACTORS415. As a general rule, and subject to such exceptions as may be authorized by theGovernment, no payment can be made to a contractor, except for work actually doneor supplies actually received. Subject to such general or special orders as may beissued by the Government in this behalf, advances, if any, made to contractorsduring the execution of a work shall invariably be recovered from their bills for thevalue of work done or supplies made before final payment is made, which must in nocase be permitted without detailed measurement.BILLS AND VOUCHERSCHAPTER IV 40 of 60WITHDRAWAL FROM <strong>THE</strong> CONSOLIDATED FUNDAND <strong>THE</strong> PUBLIC ACCOUNT

Without prejudice to the generality of the rules in this section, in makingpayments for work expenditure and the forms of bills and the detailed procedure tobe observed by departmental disbursing officers, vouchers on which such paymentsare to be made may be prescribed by departmental regulations.Section IX-Miscellaneous PaymentsREFUNDS OF REVENUE417. Refunds of revenue can be drawn only on the demands and on the receipt ofthe person entitled to receive them after production of proper authority. In caseswhere money on account of revenues due to Government were receive and creditedto Govt. account by departmental officer or where these were credited at a treasurywith which he is in account and the refundees request for payment through such adepartmental officer, the departmental officer should draw the amount on its receiptand make payments to the refundees concerned. However, on no account these maybe drawn to be lodged in a deposit account pending demand.Refund of the value of currency notes credited to Government in accordancewith the provisions of Rule 18 of the Reserve Bank of India (Note Refund) Rules,1935, shall be made by the Currency Officer by debit to Government account andsimultaneously the particulars of the original credit together with the receipt of theactual payee, shall be sent by him to the Accountant-General concerned.417-A. Government officers who have to make payments for refunds of revenue incases where moneys on account of revenue were received and credited to Govt.account by them, should, at the request of refunds, make payment of such claims asare upto Rs. 50/- from out of permanent advance or imprests which they may bepermitted to hold under the orders of the competent authority, subject torecoupment on presentation of refund bills.418. Every refund shall be noted against the original credit in the departmentalaccounts or other documents in which the moneys received are entered in detail, anda certificate of such a note having been made must be given in all vouchers forrefunds.CHAPTER IV 41 of 60WITHDRAWAL FROM <strong>THE</strong> CONSOLIDATED FUNDAND <strong>THE</strong> PUBLIC ACCOUNT

(1) Except as hereinafter provided or unless some other form has beenprescribed by departmental regulations for any particular class of refunds bills fordrawing money from the treasury on account of refunds of revenue shall be preparedin Form M. P. T. C. 44. The officer who received the original amount shall fill incolumns 1 to 5 of the Form and sign the certificate at foot, while the Treasury Officershall verify the credit by means of the particulars in columns 4 and 5 and affix hissignature in column 6 in token of his having done so.(II) Where under the provisions of S. R. 417 or 417-A, a departmental officeris required to draw the amount for refund of revenue, he will prepare a bill in formM. P. T. C. 44 duly supported by the original chalan with which the money wascredited to Govt., account to be refunded and the number and date of the chalanwith which the money was originally deposited and the amount, if any, alreadyrefunded in cases where the amounts received from more than one person werecredited by a single chalan by him and present it at the treasury after acknowledgingthe receipt thereof in the space provided for claimants signature and after scoringout the words "claimants signature".The Treasury Officer will then make the payment to the departmental officerafter verifying the credit as stated in the first paragraph of this rule.Note:1- Refunds of passport fees realized in postage stamps should be drawn inForm M. P. T. C. 44. Os. are authorised to make paymentof refund of revenue by cheques in respect of all sums paid into the treasuryby a departmental officer or on his account after due verification from C. T.Rs. sent to them by the Treasury Officers as well as from their cash bookswithout referring the refund bill to the Treasury Officer.(2) Bills for refunds of sums credited or items deposited in one treasuryshould not be made payable at any other treasury.Note:- Refund of fines be made in the district where fine was inflicted thoughcredited in another district after the presiding officer of the Court has certified on therefund voucher to the effect that the intimation of the refund has been sent to theTreasury Officer concerned to record the fact against the credit entry in the treasuryaccounts.(3) The sanction necessary for refunds of revenue is regulated by the ordersof Government. The sanction may either be given on the voucher itself or quoted init, a certified copy being attached when such orders are not separatelycommunicated to the audit office.Exception:- Refund of Irrigation Revenue credited into the treasury is sanctioned bythe Executive Engineer on a refund statement and paid departmentally, videExecutive Instruction 9 under section 47 of the Madhya Pradesh IrrigationAct, 1931(III of 1931).420. If the amount of an examination fee, or any part of it, is to be refunded, acertificate will be endorsed upon the original receipt by the Secretary, Public ServiceCommission, or the appropriate authority concerned, specifying the amount to berefunded; and the amount so authorised may be paid on presentation of the originalreceipt endorsed as above, the recipient giving his receipt below the endorsement.Note:- When a refund has to be made of a part of a lump sum remitted into thetreasury on behalf of several candidates in a school, for which a singlecollective receipt has been issued, the procedure, laid down in Subsidiary Rule419(1) should be followed.CHAPTER IV 43 of 60WITHDRAWAL FROM <strong>THE</strong> CONSOLIDATED FUNDAND <strong>THE</strong> PUBLIC ACCOUNT

The following provisions shall apply to refunds of revenue credited (other thantaxes on income), where the amount involved does not exceed Rs. 100;(i)On receipt of a refund order passed by the Collector or other officerconcerned, the Treasury Officer may at his discretion issue a notice (a)inviting the person to whom the refund is to be made to receivepayment at the treasury, and(b) intimating that on failure to complywith the invitation within one month(or such longer period as mayappear necessary) the amount of the refund will be remitted to thepayee by Postal Money Order at his expense.(ii)When the payee appears in person at the treasury, the TreasuryOfficer should see that no avoidable delay occurs in getting thevoucher for the refund signed by the payee who may then receive thepayment personally or by a duly authorized agent or by money orderat his own expense.(iii)When a money order is issued under clause(b) of the notice referred toin(i) above, the Treasury Officer should follow the procedureprescribed in Subsidiary Rule 182(1).(iv)On receipt of the money order acknowledgment duly signed by thepayee, it should be attached to the refund voucher in which the fullamount of the refund and the deduction made therefrom on account ofthe money order commission should be clearly shown; the vouchershould then be disposed of in the usual way. The Accountant-Generalwill accept such voucher with the money order acknowledgement as avalid receipt for the full amount of the refund entered therein.Note:1- Rules regarding refund of sales tax paid in excess by dealers are containedin part VIII of M. P. Sales Tax Rules, 1947.Note:2- Provision regarding refund of Electoral Deposits are contained in section 158of the Representation of the People Act, 1951(XLIII of 1951. )CHAPTER IV 44 of 60WITHDRAWAL FROM <strong>THE</strong> CONSOLIDATED FUNDAND <strong>THE</strong> PUBLIC ACCOUNT

Unless otherwise provided by any law or rule or departmental regulation, anorder for refund of revenue shall remain in force for a period of three months onlyfrom the date on which it issued, and no payment shall be made on its authoritythereafter unless it is got revalidated by the sanctioning authority.REFUND OF FINES422. (1)When an order for the refund of a fine has been passed on appeal orrevision, the court of first intense will, immediately on receipt of the order, cause anotice to be issued to the payee informing him that a refund voucher will bedelivered to him on his presenting himself and orally applying for it, and that, whenthe amount involved does not exceed Rs. 100, if he fails to appear within one month,the amount of the refund will be remitted to him by postal money order at hisexpense. On the payee's appearance, the necessary voucher, Form M. P. T. C. 44,containing on its back a certified copy of the order for refund shall be preparedwithout any delay and handed over to the payee. If the payee does not appear withinone month, and the amount involved does not exceed Rs. 100, a refund vouchershall be prepared in accordance with the above directions and sent to the TreasuryOfficer with the intimation that the payee has not appeared though one month hasexpired from the date of the issue of the notice given to him under the precedingrule. The Treasury officer will then send a money order as indicated above.Note:- The procedure in regard to repayment of compensation fine deposited isidentical with that prescribed in the above rule, with the exception that theform to be used is that of the repayment voucher with the form of payee'sreceipt for the voucher attached to it.(2) No written application for refund is to be required, but if the payeepresents one, it need not bear any court-fee stamp.(3) As a precaution against fraudulent and erroneous refunds of fines judicialofficers should be very careful in passing formal voucher for payment and inrecording the prescribed certificate. The voucherreceipted and paid is sent by the court to the treasury, and payment should be madethereof to the court, to enable it to recoup the amount of the fine or permanentadvance as the case may be.(5) If a chalan of money received is sent by the court at the same time withthe voucher, the net receipt will be taken or the net payment made, but both receiptand payment must be entered gross in the treasury cash book or registers.(6) Rewards paid out of fines realized by judicial officers and credited to"Administration of Justice-- Magisterial fines" should not be treated as refunds ofcriminal fines and charged to "Law and Justice". Such rewards are drawn on aseparate voucher classified as debitable to the department of the officer on whoseprosecution the fine was imposed.STAMP REFUNDS(7) Refunds of stamps by court can be made in the same ways refunds offines. Refunds by district officers are usually regulated by departmental reels.REFUNDS OR RENEWALS OF <strong>THE</strong> VALUE OF SPOILED OR MISUSED STAMPS.(8) Allowances for refunds or renewals of spoiled or misused stamps shouldnot be made until the certificate of destruction has been received from the Collectorof the district. Across the certificate will be endorsed, in red ink, the words; "Pay Rs.. . . . . . . . . . . . . . . . . . . . . . . . . . . . . . "(the net amount to be refund or "issuenon-judicial court-fee stamps destroyed). The procedure to be observed for the payment of compensation for land takenup for public purpose shall be regulated by the special orders reproduced inAppendix. 12.432. The Government may authorize and land acquisition officer to make all or anyof his payments by cheques on the treasury, provided no inconvenience is caused tothe payees in consequence of the property being situated at a distance from thetreasury.433. When a special officer is employed for the acquisition of land for anydepartment, the expenditure on account of pay, allowances and leave, andpensionary contributions for himself and his establishment, contingencies, etc. , ischargeable to that department as part of the cost of land. When the land is taken upby a civil officer not specially employed for the work, the pay and allowances of theofficer and the charges of his ordinary establishment and contingencies are finallybrought to account in the civil department as part of the cost of the collector'sestablishment but any special charges incurred in connection with the acquisition ofthe land in question on establishment, contingencies, etc. , are borne by thedepartment for which the land is acquired.434. The capitalized value of the abatement of land revenue is adjusted by raising adebit for the amount as a district entry in the body of the cash book and list ofpayments, and crediting it per contra to the head "Land Revenue". If the Collector isuncertain about the amount, he should refer the question to the Commissioner ofSettlements for decision. <strong>THE</strong> <strong>MADHYA</strong> <strong>PRADESH</strong> <strong>TREASURY</strong> <strong>CODE</strong>VOLUME I435(a) Discount upon stamps is allowed to certain classes of vendors under rule 34of the Madhya Pradesh Stamp Rules 1942, or rule 12 of the Rules regulation the saleof stamps under the Court Fees Act, 1870, and is given by deduction from thepurchase money. The discount is passed on a certificate from the Treasury Officerthat the discount has been actually allowed to the parties to whom it was due,according to sanctioned rules.(b) The receipts of the vendors for discount paid to them should be taken inthe last column of the register of stamp sales, etc. , in From M. P. T. C. 48, and inthe case of discount paid at sub-treasuries, the receipts should be taken on the subtreasuryschedule of stamps sold. When the vendor is unable to attend personally atthe treasury, the discount due on the purchase may be paid to the stamp vendor'sagent or servant on production of a receipt signed by the stamp vendor for theamount of commission due. This receipt should ordinarily be endorsed on the chalansent by the stamp vendor who should be provided with a supply of chalans for thepurpose. Receipts for all sums exceeding Rs. 20 whether taken in the register orseparately, should be duly stamped.(c) The schedule of stamps sold and discount paid forwarded to theAccountant-General with the treasury cash account should be prepared in Form M. P.T. C. 49, and should show only the monthly totals of the several columns of theabove register.(d) Before signing the certificate printed at foot of the schedule to accompanythe cash accounts, the Treasury Officer should satisfy himself that the discount hasbeen paid in accordance with prescribed rates and that the receipts of the vendorshave been taken in the manner indicted in sub-paragraph (b) above.Note:--Definition of "discount" and "commission"--"Discount" represents allowancemade to those licensed vendors who, by payment of ready money purchasestamps for sale to the public, while "commission" represents the allowance tothose licensed vendors who act as agents of the Government, selling stampswithout making any outlay of their own money.CHAPTER IV 53 of 60WITHDRAWAL FROM <strong>THE</strong> CONSOLIDATED FUNDAND <strong>THE</strong> PUBLIC ACCOUNT

Bills for sums payable to the Reserve Bank e. g. , bills in connection withfloatation of new loans, management of Public Debt, etc. , shall be countersigned byan officer of the Finance Department before they are paid.Note:- The Bank is authorized to debit to Government account, in advance of thesubmission of consolidated bills for expenses incurred in connection with thefloatation of a Government loan, payments which it may make to bankers,etc. , on account of brokerage, subject to the condition that the Bank acceptsthe responsibility in the event of any excess payment being made. Theadvance so made should be adjusted against the final bill of the Bank.COMMISSION AND COMMITTEES437. The procedure to be observed by commissions and committees of theGovernment in drawing moneys for their expenditure shall be governed by theorders issued in each case.COMMISSION TO PATELS IN CENTRAL PROVINCES AND MERGEDTERRITORIES FOR REVENUE COLLECTIONS.438. (a) The rules regarding the calculation and payment of commission to Patels forcollection of land revenue have been issued in the Revenue Department'sMemorandum No. 1343-6380-VII/N. I. dated the 30th January, 1960. and No. 4350-1422/VII/N-II, dated the 9th August, 1963. The collection of land revenue andpayment of Commission to Patels should be recorded separately in the treasuryaccounts and register. The commission to Patels for collection of land revenue shouldbe paid in accordance with the following slab system on the amount of collections ofland revenue and miscellaneous revenue:--6 NP. per rupee of first Rs. 1, 500/- of land revenue collected. 4 NP. perrupee of second Rs. 1, 500/- of land revenue collected.CHAPTER IV 54 of 60WITHDRAWAL FROM <strong>THE</strong> CONSOLIDATED FUNDAND <strong>THE</strong> PUBLIC ACCOUNT

He shall make entries inthis register simultaneously with the entries made by him in the Kistbandi Khatoni ofthe amounts credited into the treasury by the patel during the period from the 1stAugust to 31st July, next.(iii) The payment of commission shall be recorded at the Tahsil in a bill, inForm B, and the receipt of the Patels taken thereon. These bills will be vouchers insupport of the payment made. The payments made shall also be entered in aregister in Form C and each entry shall be signed by the Tahsildar or Naib-Tahsildar.The Tahsildar will submit, along with the vouchers, a memorandum showingseparately the progressive total of the payments made to patel for the current yearand for each of the previous years. The vouchers (Form B) and the memorandumafter they have been delet within the treasury branch, will be checked in theCollectorate.440. The commission due to the patels on account of land revenue andmiscellaneous revenue may remain, in some instances, unclaimed for years for someAll such arrears unpaid or undaimed for 3 years from 31st July of the year in whichthe emoluments fall due should be treated as having lapsed and a note should bemade accordingly in the register in Form C. For facilityof payment, patels of one Revenue Inspector's Circle may be called onone date to the tahsil headquarters for receiving the commission.Where, however, a patel does not come on the appointed date, theamount should be remitted to him by money order, less money ordercommission.(ii)On the date fixed for the disbursement of the commission theTahsildar will prepare in duplicate, bill in Form 'B' in respect of all thepatels called on that date. C. 76should be presented by the Tahsildar at the sub-treasury forencasement of the amount required for payment on a particular date.The amount drawn from sub-treasury should first be recorded in thecash book of the tahsil and then the money should be disbursed tothe patels in the presence of the Tahsildar or Naib-Tahsildar and theiracknowledgments should be obtained in column 8 of the bill in Form'B', where the patel is not present and the amount is remitted bymoney order, the money order receipt number and date may beentered in column 8 of Form 'B', After payment the bill in Form 'B'should be stamped as "paid and Cancelled" and forwarded to theCollector by the Tahsildar at the close of the month. On receipt ofthese vouchers from the Tahsildars, a Schedule in the Form M. P. T.
