THE MADHYA PRADESH TREASURY CODEVOLUME INote: 2- The rules in this sub-section do not apply to cases governed by subsidiaryrule 379.Note: 3- Whenever payment of pension is made on production of life certificate anentry (say "I. C. ") should be made in the case for the month of payment onthe reverse of the Pension Payment Order. This will enable the disbursingofficer to ascertain later at a glance the period for which the pensioner hasnot attended in person and to send out a call for his personal attendancewhich may conveniently be dispatched through the messenger sent by him toreceive payment of pension in the month previous to that in which hispresence is required.Exception:--In a case where a pension claim submitted by a pensioner is supportedby a life certificate granted under the provisions of S. R. 363, by gazettedofficer, whose specimen signature is on record with the Treasury Officer or bya Government Officer exercising the powers of a Magistrate under theCriminal procedure Code or by a Register or Sub-Register appointed underthe Indian Registration Act, under their respective seals of office personalappearance of the pensioner at the Treasury will not be insisted upon. TheTreasury Officer, however, in all cases of doubt, will be competent to obtainproof of the existence of the pensioner independent of that furnished by thelife certificate.SUB-SECTION IV-UNDERWIN PENSION AND ARREARS.GENERAL387. (1) Unless the Government by general or special orders direct otherwise, apension remaining underway for more than a year shall cease to be payable by thedisbursing officer. If the pensioner afterwards appears or a claim is presented on hisbehalf, the disbursing officer may make the payment but the arrears can be paid:---(i)if the amount in arrears does not exceed Rs. 5000/- or with theprevious sanction of the Collector of the district in which the pensionpayment office is located if it exceeds Rs. 5, 000/- but does not exceedCHAPTER IV 16 of 60WITHDRAWAL FROM THE CONSOLIDATED FUNDAND THE PUBLIC ACCOUNT
THE MADHYA PRADESH TREASURY CODEVOLUME I10, 000/- provided that in both cases the arrears are not be paid forthe first time; and(ii)in all other cases with the sanction of the authority by whom thepension was sanctioned;Provided that if in any case a pension remains undrawn for three years in thecase of a service pension or six years in the case of a political pension it cannot bepaid without the authority of the Accountant-General.Note:- If the suspension of payment is attributed to error or neglect by anyGovernment officer, the Accountant-General may direct payment of thearrears on his own authority.(Government of India's correction No. 640 to Treasury Rule 369 (1) of theCentral Treasury Rules, Vol. I)(2) A gratuity payment order shall remain in force for one year only, and nosuch order shall be retained in a disbursing office if payment has not been made onit within a year of its issue.Note: 1- Gratuity payment order remaining undisbursed or over one year, shall bere-validated by the Accountant-General, Madhya Pradesh without any formalreference to the authority by which such gratuity was sanctioned.Note: 2- The procedure applicable to service gratuity shall be applicable to thedeath-cum-retirement gratuity.DEATH OF PENSIONERS388(1) Subject to any rule or order made by the Government in this behalf, thepayment of arrears of pension due in respect of a deceased pensioner shall beregulated by the following rules:-(a)pension can be drawn for the day of man's death; the hour at whichdeath takes place has no effect on the claim.CHAPTER IV 17 of 60WITHDRAWAL FROM THE CONSOLIDATED FUNDAND THE PUBLIC ACCOUNT
