<strong>THE</strong> <strong>MADHYA</strong> <strong>PRADESH</strong> <strong>TREASURY</strong> <strong>CODE</strong>VOLUME I(b)On the death of a pensioner, payment of any arrears actually due maybe made to his heirs, provided that they apply within one years of hisdeath. They cannot be paid thereafter without the sanction of theauthority by whom the pension was sanctioned to be obtained throughthe Accountant-General.Provided that if the arrears do not exceed Rs. 10, 000/- and the casepresents no peculiar features, the Accountant-General may pass the arrears on hisown authority.(c)Subject as provided in the preceding clauses, pension claimed onbehalf of a deceased pensioner may be paid without the production ofthe usual legal authority:--(i)to the extent of Rs. 5000/- under the orders of the Collectorafter such enquiry into the rights and title of the claimant asmay be deemed sufficient:--Note:- The limit Rs. 5,000/- refers to the net and not to the gross amount.(ii)for the excess over Rs. 5000/- under the orders of the StateGovernment on execution of an idenmnity bond, with suchsureties as they may require if they are satisfied of the rightand title of the claimant and consider that undue delay andhardship would be caused by insisting on the production ofletters of administration.Note: 1- The form of indemnity bond mentioned in this clause prescribed for use inthis State has been standardized and printed as Form M. P. T. C. 18 Thesureties accepted for joining in such bond should be of proved financial abilityto meet the obligations undertaken. The bond is exempted from stamp duty.Note: 2- The powers of the State Government under this clause will be exercised byrespective Department of Government.CHAPTER IV 18 of 60WITHDRAWAL FROM <strong>THE</strong> CONSOLIDATED FUNDAND <strong>THE</strong> PUBLIC ACCOUNT
