When soil contamination is found or suspected and a responsible party isnot identified, or <strong>the</strong> responsible party fails to promptly take <strong>the</strong>appropriate action, <strong>the</strong> discharger shall have those soils sampled andtested to ensure proper handling and public safety measures areimplemented.
