plan / local area plan. The design criteria set out <strong>in</strong> the design<br />

manual will also provide a useful framework <strong>in</strong> the assessment of<br />

applications, particularly <strong>in</strong> the light of significant plann<strong>in</strong>g issues<br />

identified at pre-application meet<strong>in</strong>gs.<br />

Tak<strong>in</strong>g <strong>in</strong> Charge<br />

8.8 Plann<strong>in</strong>g authority policy on tak<strong>in</strong>g <strong>in</strong> charge should comply with<br />

Circular Letter PD 1/08, Tak<strong>in</strong>g <strong>in</strong> Charge of <strong>Residential</strong><br />

<strong>Development</strong>s/ Management Arrangements, which is available from<br />

the Department’s website at www.environ.ie. Implementation by<br />

plann<strong>in</strong>g authorities of the requirements set out <strong>in</strong> the Circular falls<br />

with<strong>in</strong> the statutory scope of these Guidel<strong>in</strong>es and is therefore<br />

covered by the provisions of Section 28 of the Plann<strong>in</strong>g and<br />

<strong>Development</strong> Acts.<br />

Circular Letter PD 1/08 requires each plann<strong>in</strong>g authority to develop<br />

or update, as appropriate, and implement a policy on tak<strong>in</strong>g <strong>in</strong> charge<br />

<strong>in</strong> accordance with the policy guidance, the ma<strong>in</strong> pr<strong>in</strong>ciples of which<br />

are as follows:<br />

• Certa<strong>in</strong> core facilities and <strong>in</strong>frastructure should be taken <strong>in</strong><br />

charge on request - public roads and footpaths, unallocated<br />

surface park<strong>in</strong>g areas, public light<strong>in</strong>g, public water supply, foul<br />

and storm water dra<strong>in</strong>age and public open spaces;<br />

• The matter of tak<strong>in</strong>g <strong>in</strong> charge should be addressed at preplann<strong>in</strong>g<br />

application stage and <strong>in</strong> the plann<strong>in</strong>g application the<br />

developer should be required clearly to identify the area to be<br />

taken <strong>in</strong> charge <strong>in</strong> due course;<br />

• Plann<strong>in</strong>g authorities should take all necessary measures to<br />

ensure proper completion of the development <strong>in</strong> particular<br />

through secur<strong>in</strong>g adequate bonds, ongo<strong>in</strong>g <strong>in</strong>spection of<br />

construction and the tak<strong>in</strong>g of enforcement action when<br />

necessary;<br />

• The procedures for tak<strong>in</strong>g <strong>in</strong> charge should beg<strong>in</strong> promptly on<br />

foot of a request by the majority of the residents <strong>in</strong> the<br />

development or by the developer, as appropriate. Protocols,<br />

<strong>in</strong>clud<strong>in</strong>g time frames, must be set out by plann<strong>in</strong>g authorities<br />

to respond to requests for tak<strong>in</strong>g <strong>in</strong> charge; and
