10168 PATTERN FOR FORMAL SETTLEMENT STIPULATION IN CA CASEpurpose of collective bargaining or other mutual aid orprotection, or to refrain from any and all such activities.[8(a)(2)](c) Dominating or interfering with the administration ofMutual Benefit Society, or dominating or interfering withthe formation or administration of any other labororganization of its employees, or from contributingfinancial or other support to Mutual Benefit Society or toany other labor organization of its employees.[8(a)(2)](d) Recognizing Mutual Benefit Society as therepresentative of any of its employees for the purposes ofdealing with Respondent concerning grievances, labordisputes, wages, rates of pay, hours of employment or otherterms and conditions of employment.[NOTE: If the case involves assistance only and not domination, the following paragraphshould be substituted for subparagraph (c) above:]“Contributing financial or other support to Mutual BenefitSociety or to any other labor organization of its employees.”[and the following language should be added to subparagraph (d):]“unless and until that organization has been certified by the<strong>National</strong> <strong>Labor</strong> <strong>Relations</strong> <strong>Board</strong> as the exclusive representtativeof those employees.”][NOTE: If the case involves a collective-bargaining agreement between Respondent andthe assisted or dominated organization, an additional provision should be added to theRevised 12/09
