11844 ORAL AND ELECTRONIC COMMUNICATIONS WITH PARTIES OR PERSONSFinal appeal letters, final compliance appeal letters, and lettersacknowledging an appeal, ruling on motions for reconsideration, andconditioning the denial of an appealClosing compliance letters11842.5 Service on Multiple Attorneys or Nonattorney Designated RepresentativesIf a party or person is represented by more than one attorney or nonattorneydesignated representative, service on any one of such attorneys or designatedrepresentatives in addition to the party or person, where appropriate, satisfies therequirements of Sec. 102.113(f) of the <strong>Board</strong>’s Rules and Regulations. However, as amatter of courtesy, an effort should be made to serve all attorneys or designatedrepresentatives of a party or person.11844 Oral and Electronic Communications with Parties or Persons(a) Party or Person Represented by an Attorney: If a party’s or person’srepresentative is an attorney, all oral and electronic communications should be directedexclusively to the attorney since the skip counsel rule applies to all forms ofcommunications, including oral and electronic communications. See Sec. 10058. Copiesof electronic communications should not be sent to the party or person unless directcontact is authorized by the attorney, or authorized by law as set forth in Sec. 11842.3(a),(b), or (c) regarding service.(b) Party or Person Represented by a Nonattorney Designated Representative: Ifa party’s or person’s designated representative is not an attorney, all oral and electroniccommunications should be directed to the representative. However, copies of electroniccommunications may also be sent to the party or person.11846 Filing and ServiceFiling of paper documents by hand delivery, by registered, certified, or regularmail, or by private delivery service satisfies the requirements for filing with the <strong>Board</strong>,the General Counsel, Regional Offices, or Administrative Law Judges. Sec. 102.114,Rules and Regulations. In addition, filing by facsimile transmission may be used incertain circumstances, as set forth below in Secs. 11846.1, .2 and .3. Electronic filing andservice of documents is also permitted as detailed on the Agency’s website athttp://www.nlrb.gov. See also Secs. 11841 and 11846.4.11846.1 Facsimile Filing PermittedParties may file unfair labor practice charges, representation petitions, objectionsto elections, and requests for extension of time by facsimile transmission, if transmittedto the facsimile machine of the appropriate office of the Agency.
