11850 CASE FILES11846.6 Registration for Electronic Service (E-Service)Parties, or their representatives, who register for E-Service at the Agency’s E-FILING site under E-GOV at http.//www.nlrb.gov (“registrants”) will receive emailnotification of and access to both E-Filed documents as described below in subparagraph(a) and the issuance of <strong>Board</strong> and ALJ decisions as described below in subparagraph (b).(a) Notification of Electronically Filed (E-Filed) Documents: Registrants for E-Service will receive email notification of documents that have been E-Filed with the<strong>Board</strong> or with the Division of Judges by another party to their case. This emailnotification will be simultaneous with the E-Filing and will provide a link to theelectronically filed document. Email notification does not relieve counsel for the GeneralCounsel or any other party from service on the other parties as required by the Rules andRegulations. See Sec. 11846.4(b). Regional Offices should review OM Memo 09-34regarding receipt of email notification, routing of the document, and placement in theRegional case file.(b) Electronic Issuance and Service of <strong>Board</strong> and ALJ Decisions: Registrants forE-Service will receive email notification of the issuance of <strong>Board</strong> and ALJ Decisionswith a link to the decision upon its posting on the Agency’s E-docket sheet. Thereafter,the decision will be posted on the Agency’s website on the following business day at 2p.m. Eastern time. Parties, or their representatives, who do not register for E-Service willcontinue to receive service of decisions by traditional means, usually by mail. However,parties, or their representatives, who register for E-Service will not receive service by anyother means. The Agency’s website at http://www.nlrb.gov and in particularmynlrb.nlrb.gov /efilingfaq should be carefully reviewed for all electronic filing andservice questions. See also OM Memos 08-66 and 09-34.11850–11860 CASE FILES AND DOCUMENTARY EVIDENCE11850 Case FilesThe paper case file should reflect all action taken in the investigation and be keptup to date. It must be sufficiently complete and current to permit appropriate supervisoryreview on an ongoing basis and, if necessary, to allow another agent to continue theinvestigation with a minimum of duplication. Although the Agency has ongoing pilotprojects utilizing electronic case files, the paper case file remains the official case file forAgency purposes.In all unfair labor practice and representation cases, Regional Offices must alsomaintain electronic file folders for each case consistent with the Agency’s revisedStandard Storage and Naming Convention Protocol for Electronic Documents and thepolicies related to E-discovery rules under the Federal Rules of Civil Procedure (FRCP)as set forth below:(a) Standard Storage and Naming Convention Protocol for ElectronicDocuments: As Regional Offices are brought onto the centralized servers, they shouldcomply with guidance set forth in OM Memos 07-55, 08-04 and 08-33 as to naming andstorage conventions for electronic documents.
