10288 SUBMISSION TO THE BOARD1. The record in this case consists of the Charge, the [Consolidated]Complaint, the Stipulation of Facts, the Statement of Issues Presentedand each party’s Statement of Position.2. This case is submitted directly to the <strong>Board</strong> for issuance offindings of fact, conclusions of law and an Order.3. The parties waive a hearing, findings of fact, conclusions of lawand order by an Administrative Law Judge.4. The <strong>Board</strong> should set a time for the filing of briefs [and oralargument].As set forth in Sec. 10284 and Sec. 102.35(a)(9), Rules and Regulations, thestipulation should set forth the agreed upon facts, a statement of the issues presented, anda short statement, not to exceed 3 pages, of each party’s position in the case. Where thereis a dispute as to the relevancy of certain facts that are stipulated to be true, the followingmay be added to the stipulation:This stipulation is made without prejudice toany objection that any party may have as to therelevancy of any facts stated herein.Eight copies of the stipulation with all exhibits and attachments should besubmitted to the Executive Secretary of the <strong>Board</strong>. Motions may also be filedelectronically at the Agency’s website under “<strong>Board</strong>/Office of the Executive Secretary.”See Sec. 11846.4.If the <strong>Board</strong> approves the stipulation, the <strong>Board</strong> will set a time for the filing ofbriefs. Answering briefs may be filed within 14 days, or such further period as the <strong>Board</strong>may allow, from the last date on which an initial brief may be filed. No further briefsshall be filed except by special leave of the <strong>Board</strong>. At the conclusion of the briefingschedule, the <strong>Board</strong> will decide the case or make other disposition of it. Sec.102.35(a)(9), Rules and Regulations.
